En esta obra, se analiza en tres capítulos la figura del menor vulnerable desde una doble perspectiva, como víctima y como victimario, en el proceso penal de menores. De los datos estadísticos disponible, la persona menor de edad que es víctima de delitos sexuales representa se sitúa en torno al 46% sobre el total de delitos sexuales registrados con un perfil de mujer mientras que el agresor menor de dieciocho años, perfil hombre, ha aumentado en los últimos años en la comisión de hechos delictivos. En ambos casos, se trata de vulnerables per se o endógenos por razón de la edad. En el caso de la persona menor de edad víctima, se ha reforzado su protección procesal con la adopción de medidas que redunden en evitar su revictimización al entrar en contacto con el sistema de justicia penal. En el lado del menor agresor, se atiende, precisamente, a esa menor edad en su formación cognitiva y volitiva con el diseño de un proceso penal especial basado en el interés superior del menor y, a partir de este principio, de las manifestaciones del principio de oportunidad reglada en el proceso penal de menores como, por ejemplo, las actividades de justicia restaurativa reguladas en el art. 19 LORPM.

A partir de un estudio de las diversas normas de los organismos regionales de control basadas en los estandares de derecho internacional humanitario se realiza un analisis mundial de las diversas formas que adquiere la violencia de genero en perjuicio, principalmente, de las mujeres y personas LGTB. El delito de violencia de genero puede incluir, entre otros, el aborto selectivo en funcion del sexo, infanticidio femenino, trafico de personas, violaciones sexuales durante periodo de guerra, homicidios a causa de la dote, matrimonios forzados, ataques homofobicos hacia personas o grupos LGTB, etc. Luego de analizar los muestreos de los casos en los diversos paises del mundo, posiblemente se generen interrogantes intelectuales acerca de la situacion real en occidente y oriente y de la necesidad de realizar un trabajo mancomunado mundial en aras de lograr que la igualdad de genero deje de ser una utopia y un precepto meramente declarativo.

From Child Sexual Abuse to Adult Sexual Risk examines the relation between child sexual abuse (CSA) and adult sexual health outcomes in men and women. The publication was developed by the United Nations Office on Drugs and Crime (UNODC) in response to the request of the General Assembly to the Secretary-General to promote and assist the efforts of Member States to become party to and implement the United Nations Convention against Transnational Organized Crime and the Protocols thereto. It was developed in particular to assist States in implementing the provisions contained in the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing that Convention. The Model Law will both facilitate and help systematize provision of legislative assistance by UNODC as well as facilitate review and amendment of existing legislation and adoption of new legislation by States themselves. It is designed to be adaptable to the needs of each State, whatever its legal tradition and social, economic, cultural and geographical conditions.

This book deals with child soldiers’ involvement in crimes under international law. Child soldiers are often victims of grave human rights abuses, and yet, in some cases, they also participate actively in inflicting violence upon others. Nonetheless, the international discourse on child soldiers often tends to ignore the latter dimension of children’s involvement in armed conflict and instead focuses exclusively on their role as victims. While it might seem as though the discourse is therefore beneficial for child soldiers as it protects them from blame and responsibility, it is important to realize that the so-called passive victim narrative entails various adverse consequences, which can hinder the successful reintegration of child soldiers into their families, communities and societies. This book aims to address this dilemma. First, the available options for dealing with child soldiers’ participation in crimes under international law, such as transitional justice and criminal justice, and their shortcomings are analyzed in depth. Subsequently a new approach is developed towards achieving accountability in a child-adequate way, which is called restorative transitional justice.
