Excerpt from A Treatise on the American Law of Vendor and Purchaser of Real Property, Vol. 1 The law of Vendor and Purchaser, once replete with many subtile qualifications and distinctions, has in the United States been reduced to a comparatively simple code. Restraints on alienation have been generally abolished; land is no longer held by precarious tenures: and the rules which govern the sale and transfer of real property, reflecting the enlightenment of this commercial age, have been made to conform more closely to those which prevail in other commercial transactions. Much of the simplification of this subject has been accomplished in recent years, and in this work an attempt has been made to compile the cases which illustrate the development of the distinctively American phases of the law. In the performance of this task the author realizes the grave responsibility of the duties he has assumed. The American law of real property has passed through many changes daring the brief period of our national existence, and, as yet, can hardly be said to have emerged beyond a formative period.
