Export controls definitively impact international cooperation in outer space. Civil and commercial space actors that engage in international endeavors must comply with space technology export controls. In the general discourse, members of the civil and commercial space community have an understanding of their domestic export control regime. However, a careful reading of the literature on space technology export controls reveals that certain questions relevant to international engagements have not been identified or answered. What is the legal-political origin of space technology export controls? How do they relate to the current international legal structure? What steps can be taken to evolve our current unilateral paradigm of space technology within the context of peaceful exploration and use of outer space? In this book, these and other relevant questions on space technology export controls are identified and assessed through an insightful case-study of the U.S. commercial communication export control regime. The findings of this case-study are used in an international legal-political analysis of international space law, public international law, and international cooperation. Breaking new ground in international legal theory, a self-justified security dilemma that is manifest in international law is identified and explained as the origin for the current paradigm of space technology export controls.

"Historically, strategic restraint was the dominant approach among nations active in outer space, all of whom understood that continued access to and use of space required holding back on threats or activities which might jeopardize the status quo of peace in space. However, recently there has been a discernible shift in international rhetoric towards a more offensive approach to defense in space. The U.S. move towards establishing a "Space Force" has been echoed by similar announcements in France and Japan. These factors, combined with a lack of transparency about actual capabilities and intentions on the part of all major players in space, creates a cyclical escalation which has led some commentators to describe this as a return to a Cold War-type arms race, and to the foreseeability of a space-based conflict. Due to many unique characteristics of the space domain, an armed conflict in space would be catastrophic for all players, including neutral States, commercial actors, and international civil society. Due to the specificity of the space domain, specialized expertise must be provided to decision-makers, and interdisciplinary opinions must be sought from a multitude of stakeholders. To that end, this volume provides a wide spectrum of perspectives from experts who have engaged together at a conference hosted by the Center for Ethics in the Rule of Law to discuss these issues. The challenges that space poses for political theory are profound. Yet until now, the exploration and utilization of space has generally reflected – but not challenged – the political patterns and impulses which characterized twentieth-century politics and International Relations. This edited volume analyses a number of controversial policies, and contentious strategies which have promoted space activities under the rubric of exploration and innovation, militarization and weaponization, colonization and commercialization. It places these policies and strategies in broader theoretical perspective in two key ways. Firstly, it engages in a reading of the discourses of space activities: exposing their meaning-producing practices; uncovering the narratives which convey certain space strategies as desirable, inevitable and seamless. Secondly, the essays suggest ways of understanding, and critically engaging with, the effects of particular space policies. The essays here seek to ‘bring back space’ into the realm of International Relations discourse, from which it has been largely removed, marginalized and silenced. This book examines the drivers behind great power security competition in space to determine whether realistic strategic alternatives exist to further militarization. Space is an area of increasing economic and military competition. This book offers an analysis of actions and events indicative of a growing security dilemma in space, which is generating an intensifying arms race between the US, China, and Russia. It explores the dynamics behind a potential future war in space and investigates methods of preventing an arms race from an international relations theory and military-strategy standpoint.
