Murray Weidenbaum has been a visiting scholar at the American Enterprise Institute and the Center for Strategic and International Studies, a speaker at meetings at the Brookings Institution, the Cato Institute, and the Heritage Foundation and has also written for their publications, and served as a reviewer of ongoing studies. In The Competition of Ideas, Weidenbaum examines the political economy of these vital institutions, drawing heavily on several decades of involvement in their activities. He is uniquely able to see their accomplishments as well as their shortcomings. Because of the importance of the activities of their organizations, and their tax-exempt status, think tanks are held to a high standard. Weidenbaum shows that sometimes think tanks are more tank than think—major think tanks are often predictable in the positions they take on public issues and are far better at analyzing the shortcomings of other elements of society than of their own operations. The overarching issue of quality control, Weidenbaum holds, deserves more attention than it has attained in the think tank world. This book presents a careful, balanced account of where think tanks have been and where they are now headed. Given the high levels of professionalism in many think tanks, a fundamental change in the attitude of their management is important. The compelling need is less for the wielder of policy than for the lucid synthesizer of relevant research and analysis. Likewise, society needs sensitivity to the long-term concerns of the citizenry more urgently than rapid response to the opportunities of the moment. Future competition, particularly among the major think tanks, could well be centered, not on achieving greater visibility, but on developing responses to economic, environmental, and national security problems that are likely to be adopted and carried out.

Significant power is exercised through webs created between different systems of national law, influenced by governments but also by transnational actors such as global corporations and transnational NGOs, and often with an overlay of formal international law or of substantial influence from international institutions. Studying the procedures used by competition institutions (dealing with specific cases concerning monopolies, mergers, anti-competitive practices) this volumes uses a template to study practices of many national institutions and the EU, and examines the interactions among these and with prescriptions of influential international bodies. Together these form a web, with existing procedural rules and practices in a particular institution criticized and alternatives championed and transmitted partly by prescription and partly by arguments of major global law firms, of global corporations, and of consultants dispatched by the ICN and other agencies. This whole process, examined for the first time in this book, is the real global governance of the procedural law and practices of market supervision under competition rules. Delving deeply into their jurisdictions and internationally, the contributors illuminate the inner workings of the systems and expose the procedure, process, and performance norms embedded within. Case studies are drawn from Australia, Canada, Chile, China, Japan, South Africa, the USA, and the EU, as well as four leading international institutions involved in antitrust, the World Trade Organization, the Organization for Economic Cooperation and Development, the United Nations Conference on Trade and Development, and the International Competition Network. The results reveal a convergence of these norms across the very different systems, a procedural norms convergence that offers a necessary counterpart to studies on substantive rule convergence. These results provide benchmarks for the field, suggest possibilities for future development, and offer lessons for all interested in competition law and global governance.

This edited volume identifies the various country specific factors that warrant changes in the design and implementation of competition laws. The book covers case studies of nine countries of differing sizes and at varying stages of economic development, that have at one stage or another repealed extant competition laws for new ones, and seeks to examine the motivations and contexts under which this was done. The countries examined include the Czech Republic, Hungary, India, Ireland, Poland, Serbia, South Africa, Tanzania and the UK. Tracing the evolution of competition regimes in the countries covered, the book provides lessons for countries still in the process of forming their competition regimes. The contributions show that the road to strong competition regimes is seldom smooth, and that social, economic and political factors in the country hugely impact on the pace and effectiveness of competition reforms. The volume also addresses the issue of when the development of competition policies and laws can be seen to be in conflict with national development strategies.
