Small-scale fisheries support millions of people around the world but they face a common issue of overcapacity and, subsequently, an overexploitation of resources. One solution to this is through the implementation of territorial-use rights in fisheries (TURFs) where specific areas are designated for fishing by specific individuals or groups while excluding all others. In El Corredor, Baja California Sur, small-scale fishers target a variety of reef fishes under a permit system managed by cooperatives using hook-and-line, of which the Pacific red snapper (Lutjanus peru) is the most important species economically and socially. After concerns arose about possible overexploitation of fishery resources, in part due to competition with industrial fishers, fishers in El Corredor became interested in establishing TURFs over their fishing grounds. Using a spatial bioeconomic model called TURFtools, we explored the possible impacts of establishing TURFs in El Corredor to provide fishers with the knowledge necessary to make informed management decisions for their fisheries. Of the five scenarios tested, we found combining TURFs with no-take reserves—whether maintained at their current size or expanded—had the highest increase in fish abundance, fisher harvest, and fisher profit in comparison to the status quo after 20 years. TURFs may be beneficial to El Corredor fishers in addressing overcapacity issues within their fisheries given they can collaborate on how best to manage these TURFs. Though the use of TURFs to manage small-scale finfish fisheries needs to be further explored, this study is the first step in exploring their efficacy.

Territorial use rights in fisheries (TURFs) have existed for centuries. They are widely available for sedentary resources. In addition, however, they have appeared in a number of marine fisheries in traditional communities and are also being acquired, legally or extra-legally, for such techniques as floating fish aggregation devices and other forms of fixed gear. TURFs provide interesting opportunities for dealing with two major aspects of fisheries management -efficient production of net benefits and equitable distribution of benefits. Further exploration of the possible adoption of TURFs as a means for management seem desirable. This paper explores some of the definitional elements of TURFs and the distinctions between territorial rights and common property. It also exercises some of the conditions that may have an effect on the creation and maintenance of TURFs. And it discusses briefly some of the implications for equitable distribution of benefits.

Gleichzeitig hat sich der Anteil der weltweiten Bestände, welche als voll ausgebeutet oder als „übernutzt“ einzustufen sind, von 65% im Jahre 1995 auf 80% im Jahre 2005 ausgeweitet. Seit Jahrzehnten werden verschiedene Maßnahmen ergriffen, um das Ausmaß dieses Zustandes einzudämmen und eine nachhaltige Nutzung der natürlichen Ressource Fisch zu schaffen. Dabei stehen Regulierungsmaßnahmen im Mittelpunkt, welche zum einen zur Regeneration der überfischten Bestände und zum anderen zur Verhinderung weiterer Schädigungen der Ökosysteme beitragen sollen. In der Literatur existiert eine Vielzahl an Studien, die den direkten Zusammenhang solcher Erhaltungsmaßnahme auf das zugrundeliegende Erhaltungsziel beschreiben. Jedoch fehlte es bislang an Forschungen, die nicht nur die direkte Auswirkung analysieren, sondern auch die zusätzlichen Effekte einer Regulierungsmaßnahme auf andere im Ökosystem lebende Arten. Diese Lücke versuchten Gelcich et. al. 2008 mit ihrer Studie zu schließen, indem sie die direkten und zusätzlichen Auswirkungen sogenannter territorialer Nutzungsrechte in Zentral-Chile untersuchten. Die Arbeit beginnt anhand eines vereinfachten Models des bioökonomischen Gleichgewichts einer Fischereiwirtschaft nach H. Scott Gordon aufzuzeigen, warum eine unregulierte Fischerei negative ökologische und ökonomische Folgen haben kann. Um diesen Problemen entgegenzuwirken werden anschließend Regulierungsmaßnahmen vorgestellt, die in der Praxis Anwendung finden und deren Implementierungsschwierigkeiten aufgezeigt. Im Hauptteil werden die Auswirkungen der Regulierungsmaßnahme territorialer Nutzungsrechte (TURFs) in Zentral-Chile anhand der Hypothese untersucht, dass ein Regulierungssystem nicht nur direkte Effekte auf das betreffende Erhaltungsobjekt hat, sondern auch zusätzlich sogenannte Add-On-Effekte auf andere Spezies aufweise kann. Die Arbeit schließt mit einer zusammenfassenden Schlussbetrachtung der wichtigsten Ergeb-nisse der Studie.

The third and main section of the document discusses ways of increasing the contribution of small-scale fisheries to poverty alleviation and food security through nine main entry points. First, the paper revisits conventional fisheries policies and legislation and makes suggestions on how those can be made more pro-poor. Next, the paper emphasizes the importance of capacity building and highlights how cross-sectoral interventions can greatly improve the livelihoods of fish-dependent communities. The paper then proposes a series of broad pro-poor or pro-small-scale fisheries principles, before discussing in greater detail three of the main management instruments adopted in fisheries: (i) property right approaches; (ii) co-management; and (iii) protected areas. The next two sub-sections discuss markets and how to make them work for the poor, and the important issue of pro-poor financing systems and subsidies.

This document aims to provide a better understanding of the wide range of rights-based fisheries management systems in Latin-America. Rights-based management in the Latin American region is evolving, thus creating a wide diversity of schemes responding to local fisheries contexts, and institutional, resource and ecosystem dynamics and governance capacities. The document has been developed in two parts. Part I (edited and co-authored by Jose Maria Orensanz) presents case studies of fisheries targeting sedentary resources while Part II (edited and co-authored by Juan Carlos Seijo) presents case studies of industrial and small-scale finfish fisheries in the region The case studies presented in Part I include the following regimes: (i) limited entry or moratoria combined with a total allowable catch; (ii) catch shares; (iii) territorial-use privileges; and (iv) territorial communal rights by [customary and indigenous users).
