Os estudos aprofundados sobre a temática mostram que os direitos do consumidor, bem como os direitos constitucionais da autonomia da vontade, da privacidade e da intimidade vêm sendo violados por sistemas autônomos de inteligência artificial, que por meio da manipulação dos dados pessoais e sensíveis cria padrões, que podem sugerir a tomada de decisões ao consumidor. Procura-se, dessa forma, responder à seguinte pergunta: como a inteligência artificial é capaz de vulnerar a autonomia do consumidor em seu poder de escolha, a partir do uso e manipulação de dados pessoais, sob a perspectiva de salvaguarda destes direitos humanos? Em decorrência do objetivo principal, elaboraram-se os seguintes objetivos específicos: a) pesquisar a sociedade de consumo e a vulnerabilidade do consumidor, buscando analisar a evolução dos conceitos no tempo e espaço. b) analisar as novas tecnologias e a inteligência artificial, pesquisando a evolução tecnológica e as suas atuais aplicações. c) validar a vulnerabilidade da autonomia do consumidor frente às relações de consumo envolvendo a inteligência artificial. Conclui-se pela necessidade de salvaguardar os direitos constitucionais e infraconstitucionais do consumidor nessa relação jurídica virtual, demonstrando que o direito à explicação ou à transparência, mesmo que amparados no CDC, necessitam de uma nova abordagem paradigmática diante dos atuais sistemas de inteligência artificial.
