Excerpt from Reports of Decisions in Probate, Vol. 3 Since that decision, section 1718, Code of Civil Procedure, has been repealed, and now the court, sitting in probate, has no power to appoint an attorney to represent minor heirs, as such, and seems to be limited to the general laws of guardian ship. Counsel for contestants say that section 1747, Code of Civil Procedure, prescribed that the court may appoint a guardian of minors who have a guardian legally appointed by will.' This is a misapprehension. The section says: The court may appoint guardians of minors who have no guardian legally appointed by will or deed. It has been thought that the practical utility of these re ports would be increased by a system of annotation. Madden, husband of the contestant, testified that about three days after Mr. Williams was buried he, the wit ness, with his wife, called on Mr. Lyons, presented to him a copy of the will and asked him if he knew anything about it, to which Mr. Lyons replied that it was a thing foreign to him; that Mr. Lyons subsequently pulled forth his ledger, looked over it, saw the name, and said that he remembered about it; that on a later occasion, when witness with his wife and Mrs. Coffey called on Mr. Lyons, the latter said that they had been down and bothering him about the matter and that he did not know the first thing about it at all (pp. 78, 79) that, on a still later occasion, the witness again went to see Mr. Lyons, alone this time, and Mr. Lyons said: The will is all right. Excerpt from Reports of Decisions in Probate, Vol. 6 Such a cordial reception has been given to the first five volumes of Coffey's Probate Decisions, published six years ago, that the publishers now feel impelled to issue a sixth or supplementary volume, to include opinions which have since been handed down by Judge Coffey, as well as early opinions omitted from the original work because supposedly destroyed in the great San Francisco fire. Not a few decisions of this latter class have been found extant in the possession of Mr. Joseph J.Dunne and Mr. Hugo D. Newhouse, members of the San Francisco Bar, through whose courtesy they are now available for publication. Many inquiries have been made from time to time as to how it was possible to obtain the material for the original five volumes, in view of the great conflagration of 1906. Perhaps no better answer, an be given than by quoting from the review of Coffey's Probate Decisions written by Mr. George Hamlin Fitch in the "San Francisco Chronicle" of July 3, 1910: "To Jeremiah V.Coffey, who is a nephew of the Judge, is due the credit of bringing out the work. At the time of the fire all the material was destroyed in the Judge's chambers. It looked as though the work would have to be abandoned. But Jeremiah V.Coffey undertook the task of collecting the materials from lawyers who had kept pamphlets and newspaper clippings or scrap-books of decisions and from old files of the 'Law Journal' and 'The Recorder.' It required faith, patience, intelligent industry, and confidence in professional appreciation, that has not been misplaced, and it is due to him that this acknowledgment be made. After all these vicissitudes and only four years after the great fire which wiped out in a few minutes the record of the labor of a lifetime, the work now appears."
