El Observatorio de la Negociación Colectiva de CCOO ha estado integrado, desde sus orígenes en el año 2000, por profesionales universitarios de distintos campos del saber, mayoritariamente especialistas en Derecho del Trabajo y de la Seguridad Social, de distintas Universidades españolas y con algunas colaboraciones de técnicos y sindicalistas con amplia experiencia en materia de relaciones laborales y negociación colectiva. La Confederación Sindical de Comisiones Obreras ha impulsado este grupo interdisciplinar que analiza los contenidos de la negociación colectiva, con el objetivo de que el resultado de sus investigaciones constituya un elemento de reflexión y apoyo para el mejor desarrollo de la actividad de las personas que conforman las mesas negociadoras de los convenios y de quienes, desde las organizaciones sindicales, les prestan asesoramiento. El trabajo que ahora se presenta es de plena actualidad pues aborda los espacios de la negociación colectiva tras un periodo intenso de reformas que han transformado de forma muy substancial el marco legal, centrándose en algunas de las materias que se han visto especialmente modificadas por estas reformas (clasificación profesional y movilidad funcional, modelos de flexiseguridad, modificación substancial de condiciones de trabajo, inaplicación convencional o descuelgue y mecanismos de solución autónoma de conflictos). El análisis de las reformas legales se ha contrastado con el de la experiencia negociadora, para lo que se han revisado y analizado 159 convenios colectivos sectoriales de ámbito estatal y autonómico y convenios de empresa de ámbito interprovincial, registrados entre el 1 de octubre de 2010 y el 7 de febrero de 2012.

In many EU Member States, the various economic crises of recent years provided grounds for a rarely equalled level of state intervention in the regulation of labour relations with an explicit aim: the decentralisation of collective bargaining. An extensive body of research – summed up and analysed expertly in the chapters of this very important book – reveals that the process of decentralisation has more often than not led to a situation where salaries and labour conditions are ever more frequently determined by direct negotiations between employer and employees, with the State becoming the sole guarantor of employee protection even as it encourages decreasing labour costs to ensure that companies remain competitive. The comparative approach offered in this book adds to this synthesis by providing examples of speci c recent developments in fourteen Member States and Turkey. Among the numerous topics and issues that arise are the following: – ‘opt-out’ clauses that derogate unfavourably from sectoral agreement standards; – extension of the employer’s unilateral decision-making power; – ‘memoranda of understanding’ imposed by the ‘troika’ (EU, ECB, and IMF); and – ‘stand-by arrangements’ imposed by the IMF. However, notwithstanding the strong emphasis on changing the structure of collective agreements by shifting the centre of gravity closer to the company, research nds promise in the reconstituted support for sector-level agreements increasingly found among very small businesses, networked businesses, and work via digital platforms. This is the rst book to take stock of the current state of collective bargaining in Europe. It is an essential study for labour and employment law practitioners, and an exemplary analysis of immeasurable value to policymakers and academics in the eld.

El presente estudio de investigación tiene como objetivo analizar la negociación colectiva reciente en las políticas de empleo, el trabajo a distancia y los derechos digitales, a partir de tres muestras de convenios colectivos diferenciadas. En el ámbito de las políticas de empleo, se aborda la contratación, el fomento del empleo, la extinción del contrato, la subcontratación productiva, las empresas de trabajo temporal y la igualdad en el empleo. En el ámbito del trabajo a distancia, se examina la delimitación del teletrabajo, los derechos de formación, clasificación y promoción profesional, el abono y compensación de gastos, el tiempo de trabajo, la prevención de riesgos laborales, el derecho a la desconexión o los derechos colectivos, entre otros aspectos. Finalmente, en el ámbito de los derechos digitales, el estudio aborda, entre otras materias, la organización del trabajo, la vigilancia y control, el ciberacoso, la desconexión digital, la prevención de riesgos laborales, la protección de datos y la representación de las personas trabajadoras. En conjunto, el estudio da continuidad a los trabajos realizados por el Observatorio de la Negociación Colectiva (ONC) de la Confederación Sindical de Comisiones Obreras (CC OO) que coordina actualmente la Fundación 1.o de Mayo. El Observatorio aúna la participación de un gran número de docentes del ámbito universitario de reconocido prestigio, que ponen todos sus esfuerzos y saberes en mejorar el conocimiento sobre el contenido y la dinámica de la negociación colectiva.

The North American Mosaic has four overarching features. First, it is, to the extent feasible, based on comparable information on the status and trends of major indicators of the state of the environment in Canada,Mexico, and the United States. Second, the report confirms that these three countries together make up an incredibly complex, dynamic, and interconnected ecosystem in which humans play a dominant and decisive role. Third, the report raises important and sometimes disquieting questions concerning the sustainability of some current trends. Finally, the report is a reminder that our economic, social, and physical well-being are utterly dependent on the life-sustaining services provided by nature. This report emphasizes the importance of developing mutually compatible economic, social, and environmental goals and policies across the three-country region.

Based on twenty case studies of universities worldwide, and on a survey administered to leaders in 101 universities, this open access book shows that, amidst the significant challenges caused by the COVID-19 pandemic, universities found ways to engage with schools to support them in sustaining educational opportunity. In doing so, they generated considerable innovation, which reinforced the integration of the research and outreach functions of the university. The evidence suggests that universities are indeed open systems, in interaction with their environment, able to discover changes that can influence them and to change in response to those changes. They are also able, in the success of their efforts to mitigate the educational impact of the pandemic, to create better futures, as the result of the innovations they can generate. This challenges the view of universities as "ivory towers" being isolated from the surrounding environment and detached from local problems. As they reached out to schools, universities not only generated clear and valuable innovations to sustain educational opportunity and to improve it, this process also contributed to transform internal university processes in ways that enhanced their own ability to deliver on the third mission of outreach
