The 1948 Declaration of Human Rights demanded a collaboration among exponents from around the world. Embodying many different cultural perspectives, it was driven by a like-minded belief in the importance of finding common principles that would be essential for the very survival of civilization. Although an arduous and extensive process, the result was a much sought-after and collective endeavor that would be referenced for decades to come. Motivated by the seventieth anniversary of the 1948 Universal Declaration of Human Rights and enriched by the contributions of eminent scholars, this volume aims to be a reflection on human rights and their universality. The underlying question is whether or not, after seventy years, this document can be considered universal, or better yet, how to define the concept of “universality.” We live in an age in which this notion seems to be guided not so much by the values that the subject intrinsically perceives as good, but rather by the demands of the subject. Universality is thus no longer deduced by something that is objectively given, within the shared praxis. Conversely, what seems to have to be universal is what we want to be valid for everyone. The present book verses on the current discussion, between authors writing within the Thomistic tradition, on the issue of human rights, and pretends to adjudicate that discussion. The positions of authors who are critical of the notion of human rights, like Michel Villey and Alasdair MacIntyre, as well as that of those who try to justify their existence and explain their nature, like Jacques Maritain, John Finnis, and others, are carefully explained and evaluated. This book is the first to deal in detail with this contemporary discussion and therefore represents an important contribution to the bibliography on the philosophy of human rights, as well as to the bibliography on the Thomistic tradition.

This book is the first comprehensive analysis of the thought of Ignacio Ellacuría, the Jesuit philosopher-theologian martyred for his work on behalf of Latin America's oppressed peoples. While serving as president of the Jesuit-run University of Central America in the midst of El Salvador's brutal civil war, Ellacuría was also a prolific writer. His advocacy on behalf of the country's persecuted majority provoked the enmity of the Salvadoran political establishment. On November 16, 1989, members of the Salvadoran military entered the university's campus and murdered Ellacuría, along with five other Jesuit priests and two women. Kevin F. Burke, SJ, shows why Ellacuría is significant not only as a martyr but also as a theologian. Ellacuría effectively integrated philosophy, history, anthropology, and sociopolitical analysis into his theological reflections on salvation, spirituality, and the church to create an original contribution to liberation theology. Ellacuría's writings directly address one of the most vexing issues in theology today: can theologians account for the demands arising from both the particularity of their various social-historical situations and also the universal claims of Christian revelation? Burke explains how Ellacuría bases theology in a philosophy of historical reality—the "ground beneath the cross"—and interprets the suffering of "the crucified peoples" in the light of Jesus' crucifixion. Ellacuría thus inserts the theological realities of salvation and transcendence squarely within the course of human events, and he connects these to the Christian mandate to "take the crucified peoples down from their crosses." Placing Ellacuría's thought in the context of historical trends within the Roman Catholic Church, particularly Vatican II and the rise of liberation theology in Latin America, Burke argues that Ellacuría makes a distinctive contribution to contemporary Catholic theology.

This book offers a new perspective on religious freedom. Its central theme is to elucidate the meaning of religion and freedom in discussions related to religious freedom and the place of religion in the public square. One often hears that either religion must be tamed by restricting its access to public power, or that in the name of neutrality and equality no religious reasoning may be used in the political sphere, as it may be coercive to other worldviews. There is also the idea that “religion” is a feature of human life essentially distinct from “secular” features such as politics and economics, and which has a peculiarly dangerous inclination to promote violence. Thus, the meaning of religious freedom in the twenty-first century seems uncertain. For that reason, it is necessary to clarify the meaning of religious freedom, especially in relation to the public sphere, in order to offer an answer that will guide us in discerning issues of religious freedom.

The second volume in an ongoing series of English translations of de Benoist's works is an examination of the origins of the concept of human rights in European Antiquity, in which rights were defined in terms of the individual's relationship to his community and were understood as being exclusive to that community alone.
