S'interroger sur l'" ordre public écologique " peut surprendre. Tout ordre public est fondamentalement un ordre social : à première vue, la nature ou l'environnement ou la biosphère ne sauraient être les porteurs d'un ordre public aux différents sens que le juriste peut donner à cette notion. Pourtant utiliser l'épithète " écologique " pour qualifier une dimension de cet " ordre public " exprime la valeur fondamentale que les hommes en société veulent attribuer au respect de leur environnement naturel. Intégrer la dimension écologique à la notion d'ordre public est essentiel à l'heure où les recherches scientifiques permettent de réaliser l'enjeu que représentent les problèmes environnementaux sur le long terme et à l'échelle mondiale. Les domaines et les approches retenues dans ce travail, fruit d'un colloque organisé par le GIDE de l'Université de Bourgogne, sont variés. Le droit international, le droit communautaire et différents droits nationaux sont pris en compte. L'approche de la science politique enrichit les études de droit privé et de droit public. L'ouvrage s'adresse non seulement aux spécialistes du droit de l'environnement mais aussi à l'ensemble des juristes et à tous ceux qui s'intéressent aux questions écologiques dans la société d'aujourd'hui.

In a cogent, detailed analysis, the author ‘reconstructs’ the legal order of the European Union in a way that best gives meaning to the Treaties, the case law of the Court of Justice, and the various underlying principles of integration that have emerged over the decades. He focuses on instances, or touchstones, in relation to which EU law seems to be building and integrating an ordre public. Among these are the following: international trade law and arbitration; public international law; the ECHR and EctHR; public policy exceptions to the four freedoms; European citizenship; competition law; national and EU procedural law; and protection of social and labour standards. In-depth inquiry into questions which seem subject to very specific limitations – such as when national or EU courts are under an obligation to raise issues of EU law of their own motion, or norms from which private parties may not deviate – captures the breadth of the EU ordre public, greatly clarifying the concept and the variety of ways it operates. Seeking to reconcile numerous strands and processes of EU law in a principled manner, the book reveals a significant potential for a deeper constitutional framework defining the EU ordre public and putting it into operation as a tool to help ensure unity in diversity. Globalization and information technology are driving the world into a new era. Is it the responsibility of business to pursue the common good - and more precisely, to participate in the construction of the global common good? This book brings together contributions from various disciplines, written by scholars who are at the forefront of this debate. It provides multiple insights into a tripartite relationship: business, globalization and the common good. It helps explain why the business sphere will probably not be in a position to ignore the common good much longer, and why this latter concept, widely ignored in today's management realm, is likely to become part of tomorrow's corporate policies and practices in the global context. Finally, this work opens up a plethora of avenues for future research, calling for the development of transdisciplinary approaches and for the elaboration of a research program embracing theoretical, empirical and spiritual perspectives to tackle this complex issue.
