La tension entre l'exigence de sécurité (aujourd'hui l'efficacité dans la lutte contre le terrorisme) et celle de protéger les libertés n'a jamais été autant au centre du débat démocratique. Cette tension nous interpelle plus que jamais à l'aune des attentats intervenus et des menaces qui pèsent aujourd'hui sur la France. La France a pris un virage sécuritaire qui s'est accéléré depuis les attentats de Charlie Hebdo à tel point que son arsenal juridique est considéré comme l'un des plus répressif en Europe. Certains y voient un sacrifice sournois et à peine dissimulé des libertés publiques au nom de l'exigence de parer à la menace terroriste et même, l'instauration d'une forme d'Etat d'exception latent. For some years, we have observed a broad public discussion over the shrinking civic space. While the focus has generally been on countries with authoritarian governance systems, it has more recently become apparent that the issue is neither restricted to these countries nor indeed to countries with weak or non-existing democracies. It has been demonstrated that the space in which civil society actors and individual citizens may contribute to public affairs is undergoing fundamental changes in Europe. While in some areas, the clout of civic initiative is larger today than ever before, in others, civic action is highly disputed and governments are attempting to crowd out non-governmental actors from the public sphere. This edited volume examines the wellbeing of civil society in the Europe and its riparian states. Lo scopo del libro è quello di presentare i risultati di una survey che ha visto coinvolti i membri di alcune Law Enforcement Agency europee e un gruppo di esperti in materia di terrorismo e radicalizzazione che sono stati interrogati sul presente e il futuro della radicalizzazione violenta in Europa. Questa ricerca è stata condotta nell’ambito del progetto TRIVALENT. Dopo una descrizione del background teorico della ricerca e della metodologia utilizzata, saranno presentati i risultati delle interviste qualitative e del questionario Delphi. La principale conclusione di questo studio è l’idea che la radicalizzazione e il terrorismo siano processi complessi e articolati in più livelli che coinvolgono sia i singoli individui sia le macro-strutture.

Examines the ways military tribunals seek to administer justice The Al-Qaeda terror attacks of September 11, 2001 aroused a number of extraordinary counter measures in response, including an executive order authorizing the creation of military tribunals or “commissions” for the trial of accused terrorists. The Supreme Court has weighed in on the topic with some controversial and deeply divided decisions. Extraordinary Justice seeks to fill an important gap in our understanding of what military tribunals are, how they function, and how successful they are in administering justice by placing them in comparative and historical context. Peter Judson Richards examines tribunals in four modern conflicts: the American Civil War, the British experience in the Boer War, the French tribunals of the “Great War,” and Allied practices during the Second World War.
