La loi Spinetta du 4 janvier 1978 réglemente la responsabilité des constructeurs, le contrôle technique et l’assurance construction pour laquelle elle a instauré une double obligation d’assurance : – une assurance dommages-ouvrage, qui oblige le maître d’ouvrage, en cas de sinistre, à proposer le préfinancement de la réparation, son assureur recourant ensuite contre les assureurs des constructeurs ; – une assurance de responsabilité, imposée aux constructeurs, qui couvre les éventuels dommages causés aux tiers. Cet ouvrage décrit ce régime et retrace ses évolutions. Il présente ainsi l’état actuel du droit de l’assurance construction, droit technique au croisement du droit de la construction, du droit civil et du droit pénal et qui demeure complexe puisque s’écartant progressivement du droit commun de l’assurance. Organisé en deux parties consacrées à l’obligation d’assurance décennale, d’une part, et à l’assurance dommages-ouvrage, d’autre part, L’assurance construction permet de maîtriser les obligations d’assurance qui incombent aux différents intervenants ainsi que d’arbitrer entre les différentes assurances complémentaires facultatives. Toutes les subtilités de la police dommages-ouvrage (DO), de la responsabilité civile décennale, de la police tous risques chantier (TRC), de la police unique de chantier, etc. y sont ainsi détaillées.
