The book provides a comprehensive overview of recent developments in Turkey’s labour dispute resolution system, and helps compare the Turkish system especially with those in European countries. Turkey passed a new Labour Courts Act in 2017, which changed Turkish labour law practice by introducing mandatory mediation for all labour disputes. The main objective behind this measure was to ensure that labour disputes are resolved more quickly and less expensively. The book was written specifically for lawyers around the globe who have to deal with Turkish law, especially those who are seeking to become specialists in dispute resolution law. In addition, it provides stimulating reading for laypersons who wish to learn what 'mediation and arbitration law are all about' in Turkey. Above all, it was prepared with a view to providing foreign investors and companies in Turkey with basic information on Turkish labour legislation.

This book focuses on the experience of social dialogue in Turkey, which is a European Union candidate country. It argues that social dialogue constitutes one of the fundamental pillars of European social model and therefore should be analysed not only at the supranational level but also at the national, sectoral and workplace levels. The book critically examines social dialogue processes and mechanisms in Turkey at various levels, with focus on the workplace because it is shaped by socio-cultural elements which contain many variables. The book also identifies the shortcomings and structural impediments of social dialogue, and provides an empirically grounded theoretical explanation of social dialogue in Turkey. In the process, the book explains and clarifies key concepts to help readers grasp important points relevant to social dialogue, and contains interviews with social partners to take into consideration their views and recommendations on social dialogue. These in-depth interviews also provide a rare insight into the dynamics of social dialogue on the ground. By looking at social dialogue at various levels, the book offers a balanced view of its strengths and weaknesses in Turkey. This book is a valuable tool for students, academics and researchers interested in understanding the complex dynamics of social dialogue and workplace relations in Turkey.

For the formation and preparation of this book, my previously published articles, which are available on my personal blog sozercizmeci.com.tr, have been compiled. As a Human Resources Professional, with experience for more than ten years, I have been working and writing in particular with respect to the recent legal developments in the fields of “Labor” and “Foreigners” with a great interest and joy. Throughout my professional career, my entire working life has focused on these relevant two terms. Because of working in a multinational culture, I have always fully believed in the success of the combination of the local and global and achievement of a balanced compromise between these two. Thus, the non-comprehensive list of topics mainly discussed in this book, specifically provides information with respect to the principles and procedures within the framework of the Turkish laws regarding the interaction between “Labor” and “Foreigners”. Nothing in this book shall be deemed as a comprehensive review of the relevant Turkish legislation. This book has been prepared as a portfolio of my works as well as a beginners’ guide for those interested in understanding the basics of the most relevant Turkish principles especially in the fields of Human Resources, Expatriates, Immigration and International Non-Governmental Organizations. This book only contains general information not any professional information or legal advice. Though I have shown ultimate attention during the formation, preparation and control of the information provided in this book as to ensure its accuracy, I shall not be held responsible for any error, omission or inaccuracy herein.
