L'Université de Maastricht, l'Université de Liège, l'Université nationale du Bénin au Bénin, l'Université du Bénin au Togo organisent, à Lomé, depuis 1997, un programme de formation au droit et à la politique de l'environnement. Les relations privilégiées nouées à la faveur de ce programme ont permis de mieux mesurer les sensibilités du Nord et du Sud face à des problèmes communs. Au mois d'octobre 2001, se sont tenues, à Liège, deux journées de réflexion sur la place de l'environnement dans le système juridique en prenant le parti de donner, sur chaque thème choisi, la parole à un intervenant du Sud et à un intervenant du Nord. Les valeurs, les acteurs et l'efficacité du droit de l'environnement ont été soumis à cette analyse. Cet ouvrage rassemble les contributions de MM. Edmond Kwam Kouassi, Anthony Ogus, Marc Pallemaerts, Valentin Yaovi Amegankpoe, David Grimeaud, M. Lawogni, Damien Geradin, Michel Pâques, Nouroudine Gibril, Mme Alida Assemboni, MM. Michel Prieur, Michel Foret, Kodjo Avode, Nicolas de Sadeleer, Koffi Ahadzi, Jean-François Neuray et Stéphane Doumbe-Bille. Législateurs, fonctionnaires, avocats, magistrats, chercheurs, enseignants et bien d'autres intéressés puiseront dans ce livre tantôt des idées générales et des informations, tantôt des analyses techniques positives, souvent des développements critiques, presque toujours la confirmation de la relativité des opinions et des systèmes.

Malgré l'existence des conventions internationales de protection de l'environnement, force est de constater le changement climatique lié à la pollution de l'air et aux autres phénomènes climatiques anormaux. Des défis économique, sociopolitique et juridique entravent la protection de l'environnement sur le plan international. Pour juguler ces défis, cet ouvrage propose des pistes : réviser le système classique de responsabilité étatique dans la convention internationale sur la responsabilité de l'État pour fait internationalement illicite ; renforcer l'application du droit international de l'environnement à l'échelon national et international.

Quel avenir pour le droit de l'environnement ? La question mérite d'être posée à l'heure où, victime de son succès, cette jeune branche du droit risque de voir ses principes se diluer dans le maquis réglementaire et ses finalités se brouiller sous le poids de la rhétorique. C'est à une réflexion de fond que convie cet ouvrage, qui entend croiser les disciplines et déployer les différentes échelles de temps et d'espace sur lesquelles se posent aujourd'hui les questions environnementales. Il s'agira, dans un premier temps, d'éclairer les fondements philosophiques et scientifiques de ce droit et d'en interroger les enjeux sociaux et politiques. On s'attachera ensuite à dégager, pour les espaces et les ressources naturels, une qualification juridique d'ensemble qui ne se ramène pas à celle d'« objet » ou de « bien » ; la fécondité des notions de res communis, de patrimoine, d'usufruit, de trust et de domaine public sera évaluée dans cette perspective. On confrontera ensuite les mérites respectifs des différents instruments de régulation juridique qui sont mis en œuvre aujourd'hui, de la codification à la contractualisation, en passant par l'élaboration de principes généraux et la reconnaissance de droits procéduraux aux particuliers et aux associations. Une attention particulière sera consacrée à l'institution de la responsabilité qui, à condition d'être repensée et élargie, pourrait dynamiser bien des règles, tant en droit interne qu'en droit international. On interrogera enfin la part que prend la réglementation européenne à la consolidation de la protection du milieu. Adoptant une perspective résolument prospective, cet ouvrage entend ainsi contribuer à dégager quelques scénarios d'avenir possibles pour le droit de l'environnement

The Council of Europe landscape convention was adopted in Florence (Italy) on 20 October 2000 with the aim of promoting the protection, management and planning of European landscape and organising European co-operation in this area. It is the first international treaty covering all aspects of European landscape. It applies to the entire territory of the contracting parties and covers natural, rural, urban and peri-urban areas. It concerns landscapes that might be considered outstanding, commonplace or deteriorated. By taking into account landscape, culture and nature, the Council of Europe seeks to protect the quality of life and well-being of Europeans in a sustainable development perspective.

Sustaining Global Growth and Development focuses on the new challenges for sustaining growth in the twenty-first century and the role of the G7 and IMF in meeting these challenges amidst the new processes of regionalism now emerging. The volume has three central purposes: · to assess how and how well the G7 has addressed its core 2002 agenda of sustaining global growth, reducing poverty in Africa, and combating terrorism and its financing · to examine how the IMF has approached these issues, and related work of the G7 · to explore how the G7, IMF and other international institutions are addressing global growth and development challenges in the context of the new processes of regionalism. Pressures such as currency consolidation in Asia and economic union in Africa are studied. This book builds on previous volumes in the series with a heavy focus on the World Bank, the regional development banks and the many other international institutions that work in the field of development.

In this publication, a number of recognized practitioners and scholars undertake to explore the realities and the conceptual underpinnings of environmental compliance mechanisms. In a relatively short period of time, such mechanisms were introduced in a wide range of new and existing environmental regimes. Yet, little is known about their function in practice and their implications. This is puzzling when considering, that the new mechanisms considerably depart from traditional patterns of counteraction and dispute settlement. Instead they build on partnership and cooperation and include a wide range of possible reactions, which range from those having coercive power to supportive measures. Quite a number of those mechanisms and their functioning are explained in the publication in order to lay ground for some cross-cutting analysis, which covers inter alia reporting, inspection and monitoring, supportive financial incentives and the interrelationship between compliance mechanisms and the principle of state responsibility and dispute settlement. Finally the role of non-governmental organizations is addressed. Practitioners and scholars in international environmental affairs and international law more generally will benefit significantly from the inside views and thorough reflection as provided for in this book.
