Esta investigación busca dar una contribución al Derecho procesal español, desde una perspectiva académica. La cual pueda brindar nuevas ideas en la profundización y concienciación de la existencia de pueblos indígenas latinoamericanos, cuyos Derechos y formas de administrar justicia gozan de reconocimiento nacional e internacional. Se pretende entonces, demostrar que éste es un tema de actualidad y con plena vigencia, incluso, dentro de un país europeo sin población indígena como lo es España.

Esta obra constituye un estudio exhaustivo sobre diferentes aspectos de la jurisdicción especial indígena como institución y fenómeno social. Está dirigida a estudiantes universitarios y profesionales en general interesados en profundizar acerca del tema del reconocimiento de los derechos indígenas, principalmente el de la potestad de administrar justicia. Representa entonces un estudio interdisciplinar que si bien centra su enfoque en el derecho, igualmente abarca la filosofía, la antropología, la sociología jurídica y la ciencia política para realizar una detallada caracterización y un riguroso análisis acerca de la regulación de la jurisdicción indígena en distintos países de América Latina, con especial énfasis en la legislación colombiana.

During the last fifteen years Latin American governments reformed their constitutions to recognize indigenous rights. The contributors to this book argue that these changes post fundamental challenges to accepted notions of democracy, citizenship and development in the region. Using case studies from Mexico, Guatemala, Bolivia and Peru, they analyze the ways in which new legal frameworks have been implemented, appropriated and contested within a wider context of accelerating economic and legal globalization, highlighting the key implications for social policy, human rights and social justice.

Gender Justice and Legal Pluralities: Latin American and African Perspectives examines the relationship between legal pluralities and the prospects for greater gender justice in developing countries. Rather than asking whether legal pluralities are ‘good’ or ‘bad’ for women, the starting point of this volume is that legal pluralities are a social fact. Adopting a more anthropological approach to the issues of gender justice and women’s rights, it analyzes how gendered rights claims are made and responded to within a range of different cultural, social, economic and political contexts. By examining the different ways in which legal norms, instruments and discourses are being used to challenge or reinforce gendered forms of exclusion, contributing authors generate new knowledge about the dynamics at play between the contemporary contexts of legal pluralities and the struggles for gender justice. Any consideration of this relationship must, it is concluded, be located within a broader, historically informed analysis of regimes of governance.

Over the past several years new constitutions have been promulgated in many Latin American countries. A notable feature of the new constitutional frameworks is the recognition of the multiethnic and pluricultural character of these Latin American societies and States. Without question this fact reflects the new weight that indigenous movements have gained in political processes in the region. The recognition of multiethnicity constitutes a significant break with the previous perspective based on homogeneity and assimilation. Although this recognition of diversity is indeed important, the real test and challenge shall be the full implementation of diversity through concrete policies and institutional reforms.
