S'interroger sur l'" ordre public écologique " peut surprendre. Tout ordre public est fondamentalement un ordre social : à première vue, la nature ou l'environnement ou la biosphère ne sauraient être les porteurs d'un ordre public aux différents sens que le juriste peut donner à cette notion. Pourtant utiliser l'épithète " écologique " pour qualifier une dimension de cet " ordre public " exprime la valeur fondamentale que les hommes en société veulent attribuer au respect de leur environnement naturel. Intégrer la dimension écologique à la notion d'ordre public est essentiel à l'heure où les recherches scientifiques permettent de réaliser l'enjeu que représentent les problèmes environnementaux sur le long terme et à l'échelle mondiale.
