This book provides a systemic understanding of how intangible cultural heritage (ICH) can promote sustainable development. It offers new insights on the identity-building potential of heritage practices as ‘enabler’ of development and their capacity to generate social and economic profits as ‘driver’ of development. Based on Pierre Bourdieu’s ‘Theory of Practice’, a model for the valorisation of ICH is presented, which may serve as a tool to stimulate the developmental potentials of heritage on a practical level. The functioning of the valorisation model is exemplified with a case study on a German choral tradition, which has not been officially nominated as ICH. Therewith, it is shown how the model can be applied to utilise the developmental potentials of ICH - as promoted in the Convention for the Safeguarding of the Intangible Cultural Heritage (2003) – even beyond UNESCO’s scope. The intangible cultural heritage (ICH) of the world's communities is an inheritance that has been passed down through many generations. Its survival, however, is increasingly threatened by the realities of post-modern society, such as rapid urbanization, large-scale migration, severe environmental change, and globalization. In 2003, the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage recognized the importance of ICH, both as a mainspring of cultural diversity and a source of sustainable development. Early efforts to implement the Convention are bringing to light issues that are crucial to the survival of ICH. Many of these involve its interaction with intellectual property law. To clarify the relationship between these two fields, this present volume gathers the views of scholars and practitioners with diverse expertise and national backgrounds. They examine four main issues: the construction and operation of ICH inventories; the conceptualization of the "community" as a holder of ICH; how to obtain the community's prior informed consent; and the pros and cons of various regulatory regimes. With the book's variety of contributions, the common thread is the belief that regulatory regimes must be designed so that ICH will not only be safeguarded in archives and museums, but also in its living form.

This book explores the international legal framework developed by UNESCO to identify and protect world heritage and its implementation at the national level. Drawing on close policy analysis of UNESCO's major documents, extensive professional experience at UNESCO, as well as in-depth analyses of case studies from Asia, Europe, and Latin America, Sophia Labadi offers a nuanced discussion of the constitutive role of national understandings of a universalist framework. For more than 40 years the World Heritage Convention has regulated the protection of the cultural and natural heritage of humankind, particularly in that heritage shall be protected if it is threatened by modern development. The international community has also adopted sustainability and sustainable development, as objectives to facilitate the protection of cultural and natural heritage. Sustainable heritage protection and use must therefore be preserved in the face of the global challenges it faces and must be perceived in terms of societal, political and corresponding economic paradigms.
