In this paper our intention is to examine the relationship between culture, human rights, in particular cultural rights, and development and to suggest possible indicators to measure and qualify this relationship. Being fully aware that a lot of material has been produced on this theme, our objective is to build on existing results and materials and study the possibility of producing understandable and quantifiable indicators. In this context we will concentrate on the cultural dimension of several specific human rights as included in international human rights instruments accepted by a large majority of States. Overarching the relationship between culture, human rights and development are the principles of equality, access and participation. These human rights are not only moral issues; they are legal obligations that should guide States in all policy-planning, including the drafting of cultural policies. Cultural policies should not be seen as a 'charity' or as derived from voluntarism; they are based on rights of people and the legal obligations of States. In this paper we plead for an integrated approach, whereby the legal framework provides the basis for the development of policies, giving them more continuity and coherence.

Human rights indicators are central to the application of human rights standards in context and relate essentially to measuring human rights realization, both qualitatively and quantitatively. They offer an empirical or evidence-based dimension to the normative content of human rights legal obligations and a provide means of connecting those obligations with empirical data and evidence, and in this way relate to human rights accountability and the enforcement of human rights obligations. Human rights indicators are important both for assessment and diagnostic purposes: the assessment function of human rights indicators relates to their use in monitoring accountability, effectiveness and impact, while the diagnostic purposes relates to measuring the current state of human rights implementation and enjoyment in a given context, whether regional, country-specific or local. This paper offers a preliminary review of the foregoing in the development context, and a general perspective on the significance of human rights indicators for development processes and outcomes. It is not intended to be prescriptive and does not provide specific operational recommendations on the use of human rights indicators in development projects. Nor does it advocate a particular approach or mode of integrating human rights in development, or argue for a rights-based approach to development. This paper is designed to provide development practitioners with a preliminary view on the possible relevance, design and use of human rights indicators in development policy and practice. It also introduces a basic conceptual framework about the relationship between rights and development, including in the World Bank context and surveys a range of methodological approaches on human rights measurement, exploring in general terms different types of human rights indicators and their potential implications for development at three different levels of convergence or integration.

What is the relationship between culture and human rights? Can the idea of cultural rights, which are predicated on the distinctiveness and exclusivity of a communitya (TM)s beliefs and traditions, be compatible with the concept of human rights, which are universal and a ~inherenta (TM) to all human beings? If we accept such compatibility, what is the actual content of cultural rights? Who are their beneficiaries: individuals, or peoples or groups as collective entities? And what precise obligations do cultural rights pose upon states or other actors in international law, or for the international community as a whole? International instruments on the protection of human rights do not provide self-evident answers to these questions. This book seeks to analyse these dilemmas and to assess the impact that they are having on international law and the development of a coherent category of cultural human rights.
