The SSF Guidelines are based on internationally accepted human rights standards and are to be interpreted and implemented in accordance with those standards. Their objectives are to be met through the promotion of a human rights-based approach (HRBA). This approach seeks to ensure the participation of small-scale fishing communities in non-discriminatory, transparent and accountable decision-making processes by putting particular emphasis on the needs of vulnerable and marginalized groups and developing countries. While the HRBA has been recognized by FAO as a principle that informs the design, implementation, monitoring and evaluation of programmes and projects,1 there is still limited experience in its practical application in the context of small-scale fisheries (SSF). It is therefore important to explore how the approach could support the implementation and monitoring of the SSF Guidelines. Accordingly, the workshop on “Exploring the human rights-based approach in the context of the implementation and monitoring of the SSF Guidelines” explored what the human rights-based approach means within the context of small-scale fisheries in general and the thematic areas covered by the SSF Guidelines in particular. It discussed what the HRBA entails in terms of the conduct of the various state and non-state actors to whom the SSF Guidelines are addressed as well as the needs of the different stakeholders in the various policy areas, with a view to developing guidance materials for the application of the HRBA in the implementation and monitoring of the SSF Guidelines.

In June 2014, FAO member-states endorsed the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries (SSF Guidelines). These Guidelines are one of the most significant landmarks for small-scale fisheries around the world. They are comprehensive in terms of topics covered, and progressive, with their foundations based on human rights and other key principles. It can be anticipated that implementing the SSF Guidelines, whether at local, national, or regional levels, will be challenging. This book contains in-depth case studies where authors discuss the extent to which the Guidelines can help improve the realities of small-scale fishing men and women globally and make their livelihoods and communities more secure. This will require policy intervention and innovation, along with contributions of civil society organizations and academia. However, most of all it will necessitate the empowerment of fishing people so that they can become active participants in decision making on matters where their well-being and human rights are at stake. By endorsing the SSF Guidelines, states have committed themselves to support and facilitate this development. This book asks whether states can successfully “walk the talk,” and provides advice as to how they can do so. The collection of case studies sets the platform for an interactive dialogue space for researchers, policy makers, civil society and small-scale fishing communities to start the conversation about the monitoring and evaluation of the implementation of the SSF Guidelines at local, national, regional and global levels. The 2018 edition of The State of World Fisheries and Aquaculture emphasizes the sector’s role in achieving the 2030 Agenda for Sustainable Development and the Sustainable Development Goals, and measurement of progress towards these goals. It notes the particular contributions of inland and small-scale fisheries, and highlights the importance of rights-based governance for equitable and inclusive development. As in past editions, the publication begins with a global analysis of trends in fisheries and aquaculture production, stocks, processing and use, trade and consumption, based on the latest official statistics, along with a review of the status of the world’s fishing fleets and human engagement and governance in the sector. Topics explored in Parts 2 to 4 include aquatic biodiversity; the ecosystem approach to fisheries and to aquaculture; climate change impacts and responses; the sector’s contribution to food security and human nutrition; and issues related to international trade, consumer protection and sustainable value chains. Global developments in combating illegal, unreported and unregulated fishing, selected ocean pollution concerns and FAO’s efforts to improve capture fishery data are also discussed. The adoption of Voluntary Guidelines to Support the Progressive Realization of the Right to Adequate Food in the Context of National Food Security (Right to Food Guidelines) in 2004 and the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) in 2014 were two major achievements in the effort to ensure food security and nutrition. This handbook has been developed to support the joint implementation of the SSF Guidelines and the Right to Food Guidelines through an integrated approach and to increase policy coherence and uptake. The document provides an overview of the contents of these voluntary guidelines and identifies potential synergies. It also explains the human rights-based approach and discusses some crucial areas, with special attention to the specific roles and responsibilities of key actors. This document is primarily directed at those involved in the integration of the SSF Guidelines and the Right to Food Guidelines into national policies and development programmes targeting the small-scale fisheries sector in the context of food security and nutrition. However, it can be equally interesting to other stakeholders who take part in the implementation of the provisions of both instruments in their day-to-day activities and who are concerned with the sustainability of the small-scale fisheries sector. This diagnostic tool advances the implementation of the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) through policy and legal frameworks. It is a key tool for use by any actor, including small-scale fishers, who is interested in contributing to the SSF Guidelines operationalization at the national level. By using this tool, users are able to recognize the national policy and legal instruments that are relevant to small-scale fisheries in a country, consistent with the SSF Guidelines. Users are also able to: assess policy coherence for SSF; assess the alignment of national fisheries policy and legal instruments with the SSF Guidelines; identify gaps and strengths in these instruments; and further propose recommendations for improving the existing national policy and legal framework according with the SSF Guidelines.

The Voluntary Guidelines for Securing Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) are the first international instrument dedicated entirely to the small-scale fisheries sector. While the implementation of the SSF Guidelines will require legal and regulatory adjustments beyond national fisheries legislation to ensure political and legislative coherence and fully reflect the breadth of their provisions, the fundamental function of fisheries law in a sustainable use, management, and the development of small-scale fisheries is indisputable. Appropriate fisheries legislation provides the strongest possible framework for inclusive, participatory fisheries governance and resource management by providing a coherent basis for implementing and enforcing the SSF Guidelines and other related international and regional agreements and commitments. Legislation can therefore be a tangible way to support small-scale fishers, fish workers, and their communities and contribute to broader development goals, including the progressive realization of the right to food, poverty eradication, equitable development, and sustainable resource utilization. This document, Legislating for Sustainable Small-Scale Fisheries – A guide and considerations for implementing aspects of the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication in National Legislation, is a tool for States to strengthen their fisheries legislation in order to establish conditions for inclusive and sustainable small-scale fisheries development, taking into account the interrelatedness of social, economic and environmental sustainability, while focusing on marginalized groups.
