"In this book Elizabeth Walgenbach argues that outlawry in medieval Iceland was a punishment shaped by the conventions of excommunication as it developed in the medieval Church. Excommunication and outlawry resemble one another, often closely, in a range of Icelandic texts, including lawcodes and narrative sources such as the contemporary sagas. This is not a chance resemblance but a by-product of the way the law was formed and written. Canon law helped to shape the outlines of secular justice. The book is organized into chapters on excommunication, outlawry, outlawry as secular excommunication, and two case studies-one focused on the conflicts surrounding Bishop Guðmundr Arason and another focused on the outlaw Aron Hjǫrleifsson"--

This collection of highly original essays by leading early medieval historians honours the work and career of Dame Janet (Jinty) Nelson, one of the most respected and influential scholars of her generation. The essays build on the spirit of Janet Nelson’s work by linking the study of Francia with at least one other area or general theme of early medieval history. The papers range across all of the regions of Europe affected by Frankish culture and explore themes which reflect the cutting edge of the work she inspired: memory, queenship, the treatment of prisoners of war, penance, the use of property, historiography, palaeography, prosopography and religious organization. The volume includes an appreciation of her career, and is rounded off by a topical index to highlight its thematic aspects. The contributors are drawn from those who have worked alongside Janet Nelson and from some of her former students. They include David Bates, Stephen Baxter, Wendy Davies, Paul Fouracre and David Ganz.

This book tells one part of the long history of the institution of marriage. Questions concerning the formation and annulment of marriage came under the exclusive jurisdiction of the church courts during the Middle Ages. Drawing on unpublished records of these courts, Professor Helmholz describes the practical side of matrimonial jurisdiction and relates it to his outline of the formal law of marriage. He investigates the nature of the cases heard, the procedure used, the people involved and changes over the period covered, all of which add to what is known about marriage and legal practice in medieval England. The concluding assessment of canonical jurisdiction over marriage suggests that the application of the law was more successful than is usually thought.
