Los presentes Estudios de filosofía del Derecho y Derecho penal tienen, en primera línea, un sentido revisionista y analítico. El libro recoge artículos sobre temas clásicos del Derecho penal (teoría de la pena, dogmática de la omisión, teoría de las normas, etc.), que son analizados desde unas coordenadas filosóficas que resultan familiares en nuestra tradición jurídico-penal. Sin embargo, la agudeza de los estudios que ofrece este volumen arroja como resultado señales de alerta sobre el modo en que estamos analizando el Derecho penal y sus principales instituciones. Por ello, subliminalmente es un libro de crítica al Derecho penal de hoy, pero una crítica que no estamos acostumbrados a leer por su profundidad y originalidad. Las debilidades y yerros de ciertos constructos dogmáticos y la incipiente moralización del Derecho penal son puestos al desnudo con maestría por Kurt Seelmann, quien al tiempo orienta su crítica hacia la construcción y evolución del saber jurídico-penal. Kurt Seelmann realizó estudios en Derecho y Filosofía en la Universidad de Múnich, donde también obtuvo el grado de doctor. Se habilitó en Derecho penal, Derecho procesal penal, Filosofía del Derecho e Historia del Derecho europeo en la Universidad de Sarre en Sarrebruck. Ha sido catedrático y decano en la Facultad de Derecho de la Universidad de Hamburgo, y en 1995 asumió la cátedra de Derecho penal y Filosofía del Derecho en la Universidad de Basilea.

As conceptualized throughout this richly illustrated book, the Bastille Effect represents the unique ways that former prisons and detention centers are transformed, both physically and culturally. In their afterlives, these sites deliver critiques of political imprisonment and the sustained efforts to hold perpetrators accountable for state violence. However, for that narrative to surface, the sites are cleansed of their profane past, and in some cases clergy are even enlisted to perform purifying rituals that grant the sites a new place identity as memorials. For example, at Villa Grimaldi, a former detention and torture center in Santiago, Chile, activists condemn the brutal Pinochet dictatorship by honoring the memory of victims, allowing the space to emerge as a "park for peace." Throughout the Southern Cone of Latin America, and elsewhere around the globe, carceral sites have been dramatically repurposed into places of enlightenment that offer inspiring allegories of human rights. Interpreting the complexities of those common threads, this book weaves together a broad range of cultural, interdisciplinary, and critical thought to offer new insights into the study of political imprisonment, collective memory, and postconflict societies.
