Eco-labelling is one of the key tools used by policy-makers in many parts of the world to encourage more sustainable production and consumption. By providing environmental information on products and services, eco-labels address both business users and consumers and range from mandatory approaches, such as required product declarations, to voluntary approaches, such as national eco-labels. Eco-labels can play an important role in environmental policy. They reward and promote environmentally superior goods and services and offer information on quality and performance with respect to issues such as health and energy consumption. Eco-labels fit well into a multi-stakeholder policy framework – as promulgated recently by the EU's integrated product policy (IPP) – since the development of criteria for labels and the acceptance in the market requires the involvement of a wide range of different parties, from government and business, to consumers and environmental organisations. However, many eco-labelling schemes have had troubled histories, and questions have been raised about their effectiveness. So, are eco-labels an effective tool to foster the development, production, sale and use of products and to provide consumers with good information about the environmental impacts of those products? Is eco-labelling useful to business as a marketing tool? What factors contribute to the development of successful schemes? More than ten years after its establishment, can the EU Flower be considered a success? Are national eco-labels such as the German Blue Angel and the Norwegian White Swan more effective? Should eco-labels be harmonised? Are eco-labels achieving their original aim of fostering sustainable production and consumption? For which product groups are ISO type I eco-labels appropriate and inappropriate? Are other labels, such as mandatory, ISO type II and ISO type III labels more effective in some cases? Are eco-labels focusing on the main environmental policy targets or just on "low-hanging fruit"? Are eco-labels really linked to other tools of IPP? The Future of Eco-labelling provides answers to all of these questions. In this report (HC 243, session 2008-09, ISBN 9780215529220) the Environmental Audit Committee calls for a sector-based universal labelling scheme comparable to those emerging for food products. The Committee says the Government should be prepared to legislate for such a scheme if necessary. The Committee found greenwash - the use of insubstantial or meaningless claims to promote a product - to be a growing problem and that the Government has a role in policing ’green' labels. Commenting on the report, Colin Challen MP, Chairman of the Environmental Information Sub-Committee, said: "The Government has to act to deal with the problem of greenwash. Clear labels are needed to help consumers make informed choices but for consumers to have confidence in them, environmental labels must be backed up by independent monitoring that is fully verified." Further, that "The proliferation of labels means we urgently need a universal scheme to help consumers discriminate between products on the basis of environmental factors. A robust labelling regime would also change the way many businesses behave and help drive up environmental standards across whole sectors of the economy." The Committee calls for more resources to be put into environmental labelling, including efforts to raise public awareness. It also wants more information to be made available on the standards and processes that underpin any label, with the Government setting clear standards and guidelines on the content and presentation of such information. In addition, the Committee emphasises that the Government should encourage carbon labelling on all products as part of a universal sector-based environmental labelling scheme.

Environmental labelling schemes could have dramatic implications for trade relations, economic development, and the environment. But prior to the publication of Environmental Labelling Programmes, there had been no thorough study of the legal limits applicable to these schemes. In addition to examining the economic rationale behind environmental labelling and the policy issues associated with labelling schemes, this study explores the extent to which environmental labelling schemes can: operate in conformity with the requirements of general international law (specifically the principles of sovereignty and jurisdiction) adhere to the guidelines agreed upon at the United Nations Conference on Environment and Development function in accord with obligations arising pursuant to the WTO Agreement.
