With terrorism still prominent on the U.S. agenda, whether the country's prevention efforts match the threat the United States faces continues to be central in policy debate. Does the country need a dedicated domestic intelligence agency? Case studies of five other democracies--Australia, Canada, France, Germany, and the UK--provide lessons and common themes that may help policymakers decide.

This paper, the Domestic Approach to National Intelligence, describes certain key roles and relationships that characterize efforts by members of the U.S. Intelligence Community (IC) and federal, state, local, tribal and territorial (FSLTT) government organizations to engage with one another to carry out the shared mission of protecting the homeland. These partners work with one another, and through established channels with the private sector (e.g., critical infrastructure owners and operators), as part of a complex web of relationships. Each partner, regardless of level, plays an important role in protecting the homeland with respect to warning, interdiction, prevention, mitigation, and response. The importance of partnerships and collaboration is emphasized in this paper, as is the IC's responsibility to the public to protect privacy, civil rights, and civil liberties. Descriptions related to organizational responsibilities and/or authorities are provided by the respective agencies. The Domestic Approach to National Intelligence is consistent with the framework and recommendations outlined in the Criminal Intelligence Coordinating Council's (CICC) National Criminal Intelligence Sharing Plan, the strategies in support of the National Network of Fusion Centers, and information sharing and safeguarding standards outlined by the Program Manager for the Information Sharing Environment (PM-ISE). By describing these roles and relationships in one place, this paper strives to foster an important national dialogue that will promote a better understanding of how the IC engages with key partners in this domestic enterprise and supports the holistic ideals articulated by the Director of National intelligence (DNI).

The 1970s revealed a number of infamous and sometimes illegal practices used by federal law enforcement agencies to monitor political dissent in the United States. In the aftermath of Watergate the revelation of serious abuses created distrust of virtually all domestic intelligence operations and led to vigorous efforts at reform. Richard E. Morgan emphasizes the importance of guarding against an overreaction to the disclosures of the mid-1970s. While acknowledging the need for many of the recent reforms that seek to establish accountability, guarantee privacy, and protect dissent, he cautions against limitations on domestic intelligence gathering that could seriously hamper government's ability to prevent crime, particularly terrorism. Domestic Intelligence has several major objectives: to trace the way in which government agencies became involved with domestic intelligence gathering; to review the controversies and abuses associated with these agencies, especially the FBI, the CIA, and the NSA; to discuss the constitutionality of domestic intelligence collection; to review intelligence reforms adopted; and to suggest additional reforms. This volume is concerned with the tension between the need to protect privacy and political dissent and the need for the government to protect the community. Morgan concludes that intelligence operations aimed at anticipating criminal activity are necessary in a complex, highly vulnerable society, and that these operations can be conducted responsibly with proper guidelines and oversight mechanisms.

COINTELPRO. An acronym for Counterintelligence Program, this is the code name the FBI gave to the secret operations aimed at five major social and political protest groups--the Communist party, the Socialist Workers Party, the Ku Klux Klan, black nationalist hate groups, and the New Left movement. Spying on America, the first book to chronicle all five of the operations, tells the story of how the FBI, from 1956 until COINTELPRO's exposure in 1971, expanded its domestic surveillance programs and increasingly employed questionable, even unlawful, methods in an effort to disrupt what amounts to virtually our entire social and political protest movement. Violations of citizens' constitutional rights were rampant, and the secret operations actually resulted in a number of deaths. At the time, neither the public nor the news media knew anything about COINTELPRO. In vivid detail, Spying on America demonstrates that the system of checks and balances designed to prevent such occurrences was simply not functioning--until an illegal act uncovered the secret activities. The book opens with the daring raid of a Media, Pennsylvania FBI office by a group that adeptly used its booty--about 1,000 classified documents--to make COINTELPRO operations public. The burglars, who called themselves the Citizen's Commission to Investigate the FBI, used sophisticated methods (the FBI never caught up with them), releasing copies of incriminating documents to the media at carefully timed intervals. Spying on America draws on newspaper and magazine articles, interviews with many of the people involved, and FBI memos to trace the historical beginnings and operating methods of COINTELPRO efforts against each of the five targeted groups.
