En los últimos años, el Derecho de daños ha ido adquiriendo un papel cada vez más preponderante tanto en el ámbito doctrinal como, sobre todo, en el jurisprudencial Sin lugar a dudas, la responsabilidad civil se consagra, en pleno siglo XXI, como una de las materias más vivas y medulares del Derecho civil. Tan es así que, hoy día, constituye una disciplina jurídica con autonomía y entidad propias, cuyo tratamiento es, cada vez, más esmerado a la par que singularmente complejo, pues se halla en permanente mudanza como consecuencia de la aparición de nuevas formas de dañar y de nuevos riesgos, de ahí su tendencia inevitablemente expansiva.
