This book provides a comparative account of the abolition of concubinage in East Asia, offering a new perspective and revised analysis of the factors leading to – and the debates surrounding – the introduction of a new Marriage Reform Ordinance in Hong Kong in 1971. It uses this law as a platform to examine how the existence of concubinage – long preserved in the name of protecting Chinese traditions and customs — crucially influenced family law reforms, which were in response to a perceived need to create a ‘modern’ marriage system within Hong Kong’s Chinese community after the Second World War. This was, by and large, the result of continued pressure from within Hong Kong and from Britain to bring Hong Kong’s marriage system in line with international marriage treaties. It represented one of the last significant intrusions of colonial law into the private sphere of Hong Kong social life, eliminating Chinese customs which had been previously recognised by the colonial legal system’s family law. This book contextualizes the Hong Kong situation by examining judicial cases interpreting Chinese customs and the Great Qing Code, offering a comprehensive understanding of the Hong Kong situation in relation to the status of concubines in Republican China and other East Asian jurisdictions. It will be of particular interest to teachers and students of law, as well as researchers in gender studies, post-colonialism, sociology and cultural studies.

In the long course of late imperial Chinese history, servants and concubines formed a vast social stratum in the hinterland along the Grand Canal, particularly in urban areas. Concubinage and Servitude in Late Imperial China is a survey of the institutions and practice of concubinage and servitude in both the general populace and the imperial palace, with a focus on the examination of Ming-Qing political and socioeconomic history through the lives of this particular group of distinct yet associated individuals. The persistent theme of the book is how concubines, appointed by patriarchal polygamy, and servants, laboring under the master-servants hierarchy, experienced interactions and mobility within each institution and in associating with the other. While reviewing how ritual and law treated concubines and servants as patriarchal possessions, the author explores the perspectives available for individualconcubines and servants and the limitations in their daily circumstances, searching for their “positional powers” and “privilege of the inferiors” in the context of Chinese culture during the Ming-Qing time period. This book paints a vivid picture of women's active involvement in reshaping intimate and public sexual life in East Asia. In bringing together exciting new feminist research on sexuality from East Asia and making it available to a wider audience, East Asian Sexualities unsettles stereotypes, rectifies lack of awareness and demonstrates that East Asia matters. The chapters address the diversity and variety of everyday sexual lives and sexual politics in China, Hong Kong, Taiwan, Korea and Japan. They range from workplace sexual cultures, trans-national sexual relations, the conditions of sex-work and the emergence of new sexual desires, cultures and movements. The contributors highlight the gendered and sexual consequences of globalization and rapid social change. In doing so, they engage with western debates on late modernity while also exploring the contested understandings of modernization and westernization in the East. Until now our understanding of marriage in China has been based primarily on observations made during the twentieth century. The research of ten eminent scholars presented here provides a new vision of marriage in Chinese history, exploring the complex interplay between marriage and the social, political, economic, and gender inequalities that have so characterized Chinese society.

China has become accessible to the west in the last twenty years in a way that was not possible in the previous thirty.
