El presente libro contiene dos textos sobre temas de mucha importancia para Colombia. El primer texto sobre Nociones básicas del derecho internacional humanitario presta una especial utilidad como introducción a las nociones básicas del dih y puede servir para informar tanto a académicos como prácticos sobre algunos nuevos desarrollos en dicha materia. El segundo texto sobre El crimen de agresión después de Kampala analiza el acuerdo sobre la definición y las condiciones para el ejercicio de la competencia respecto del crimen de agresión en virtud del artículo 5.º (2) del Estatuto de Roma que fue logrado en la primera de las Conferencias de Revisión del Estatuto de Roma de la Corte Penal Internacional realizada en Kampala, Uganda, del 31 de mayo al 11 de junio de 2010.

Este nuevo libro de la colección de derechos humanos ofrece un elenco de algunas de las principales cuestiones a debatir en torno al uso de la fuerza y a la protección de los derechos humanos en el nuevo orden internacional, con el marco de referencia de dos importantes documentos de la ONU sobre el particular: el Informe del Grupo de Alto Nivel de la ONU y el del secretario general de la Organización sobre los conflictos recientes, reflejo de la preocupación por reafirmar la vigencia del procedimiento y las normas sobre la utilización de la fuerza armada establecidos en la Carta de la ONU. En el libro se analizan los citados informes y la actuación del Consejo de Seguridad en recientes resoluciones. Se incluyen otros trabajos que se ocupan de problemas actuales relacionados con la respuesta en términos de uso de fuerza en las relaciones internacionales, desde el crimen de agresión a la Opinión Consultiva de la CU a propósito del debate abierto sobre la construcción del muro de Israel en defensa contra el terrorismo, en uno de los escenarios particularmente más sensibles del panorama internacional. El Derecho internacional aplicable en materia de protección de los derechos y libertades en los territorios ocupados es también objeto de atención en este volumen. Finalmente, se recogen otros temas de especial relevancia en el orden internacional actual: el traslado forzoso de la población durante los conflictos armados, las crisis alimentarias y el Derecho Internacional Humanitario, y las nuevas iniciativas para el fortalecimiento del Convenio sobre ciertas armas convencionales.

This volume is an updated and revised version of the General Course on Public International Law delivered by the Author at The Hague Academy of International Law in 2005. Professor Cançado Trindade, Doctor honoris causa of seven Latin American Universities in distinct countries, was for many years Judge of the Inter-American Court of Human Rights, and President of that Court for half a decade (1999-2004).
