L’Union internationale des huissiers de justice (UIHJ) a été créée en 1952. Elle regroupe une centaine de Chambre Nationales, associations professionnelles ou services publics d’exécution émanant de 5 continents. Elle a pour vocation de représenter ses membres auprès des organisations internationales et d’assurer la collaboration avec les organismes professionnels nationaux. Elle pourvoit à l’amélioration des droits procéduraux nationaux et des traités internationaux. Elle s’efforce de promouvoir les idées, les projets et les initiatives tendant au progrès et à l’élévation du statut indépendant de l’huissier de justice. Dans un espace planétaire largement dominé par l’économie, il importe que les juristes remplissent leur rôle en renforçant la présence et le prestige de la justice. S’agissant du droit de l’exécution, l’UIHJ entend mettre à profit son expérience et son influence pour assurer l’effectivité de l’exécution des décisions de justice partout où cela sera possible. Tous les trois ans, l’UIHJ organise un congrès international, lieu de grandes réflexions prospectives. Le thème du congrès de Washington DC (USA) en 2006, « L’harmonisation des procédures d’exécution dans un espace de justice sans frontières », a consacré la naissance du Code mondial de l’exécution, publié en 2015 à l’occasion des travaux du congrès international des huissiers de justice à Madrid (Espagne), fondant les bases d’une harmonisation universelle des règles d’exécution. Depuis, l’UIHJ travaille à la construction d’un ensemble normatif, pour fournir à tous les États des règles simples, efficaces pour permettre à tous les systèmes judiciaires d’utiliser un langage commun. L’exécution digitale représente incontestablement aujourd’hui le plus grand défi auquel le monde doit fait face en matière d’exécution des décisions de justice. Le Code mondial de l’exécution digitale, destiné à s’intégrer au Code mondial de l’exécution, est le résultat du travail de l’UIHJ et du Conseil Scientifique dans ce domaine. =============== Every three years the UIHJ organises an international congress, which provides an occasion to reflect and discuss future developments. The theme of the Washington, DC (USA) congress in 2006, “The harmonisation of enforcement procedures in an area of justice without borders”, enshrined the birth of the Global Code of Enforcement. The Code was published in 2015 on the occasion the work of the international congress of judicial officers in Madrid (Spain), laying the foundations for universal harmonisation of the rules of enforcement. Since then, the UIHJ has been working on building a set of standards, to provide all States with simple, effective principles to allow all judicial systems to use a common language.

Il s’agit des travaux écrits du congrès mondial des huissiers de justice. Lors de ce congrès (qui se déroule tous les 3 ans) qui se tient à Dubaï fin novembre on désire donner un aperçu de la profession au travers du monde et des pays. Il s’agit de montrer ici particulièrement quel a été l’impact du Covid et de quelle manière la profession a réagie surtout au niveau de la digitalisation. Il s’agit de montrer que l’humain n’est pas dissociable de la digitalisation dans une matière aussi sensible que l’exécution forcée. Il s’agit de la première fois pour l’UIHJ de publier un ouvrage distribué au congrès qui sera disponible à la vente. Les résultats des travaux qui amènent à cet ouvrage sont cruciaux et important pour l’avenir de notre profession. L’expérience qui existe au sein de chacun des 93 membres de l’UIHJ est une richesse dont tout le monde doit s’inspirer dans un domaine aussi sensible que l’exécution forcée. Par ailleurs nous constatons dans notre profession d’huissier de justice que notre monde est entouré de la digitalisation et qu’on assiste à une émergence de notions que nous avons du mal à cerner tel que Blockchain, AI, Big Data, Machine Learning... au début ces termes ne nous faisaient pas peur, depuis l’apparition de la justice prédictive, des smart contrat qui s’auto exécutent il est temps pour la profession de réagir. L’ouvrage se veut donc le résultat de cette recherche à travers le monde afin de proposer des pistes et solutions concrètes de quelle manière l’huissier de justice peut-il enrichir la digitalisation dans un monde où on veut le contraire, c’est-à-dire promouvoir la fin des tiers de confiance.

The collective volume “Modern Forms of Work. A European Comparative Study” evokes the intent to embody a reflection focused on modern labour law issues from a comparative perspective. A first set of essays contains national reports on modern forms of work. The second group contains some reflections regarding critical issues on digitalization, platforms and algorithms, analysing the different facets of the galaxy of digital work. The third group of essays flows into the section entitled “new balances and workers’ rights in the digital era”, a crucial topic in the debate. The complex of the writings, despite the diversity of approaches and methods, reveals the existence of a dense and inexhaustible dialogue between young scholars, at European and extra-European level. The analysis of new forms of work – the offspring of transnational processes of globalization and technologization – forms a fertile ground for experimenting a transnational dialogue on which young researchers can practice with excellent results, as this small volume confirms.

The editors’ substantive introduction and the specially commissioned chapters in the Handbook explore the emergence of transnational labour law as a field, along with its contested contours. The expansion of traditional legal methods, such as treaties, is juxtaposed with the proliferation of contemporary alternatives such as indicators, framework agreements and consumer-led initiatives.
