This book contrasts and compares the different application of the law relating to the welfare interests and rights of children in France and Germany. It does so by applying the same matrix of indicators to explore jurisdictional differences between welfare interests and rights in the contexts of public family law (civil – care and protection etc and criminal – youth justice etc); private family law (matrimonial, adoption etc); and hybrid public/private family law (wardship, adoption from state care etc). By profiling the nations in accordance with the same indicators it reveals important jurisdictional differences in the extent to which welfare interests or rights determine how the law is currently applied to children in France and Germany. Professionals in child welfare and protection are often required to make decisions--fraught with many difficulties and shortcomings--that have crucial implications for children and families. This book offers insights and perspectives from a study of “Cultural Encounters in Intervention Against Violence” (CEINAV) in four EU-countries. Seeking a deeper understanding of the underpinnings of intervention practices in Germany, Portugal, Slovenia and the United Kingdom, the team explored variations in institutional structures and traditions of law, policing, and social welfare. Theories of structural inequality and ethics are discussed and translated into practice.

This volume addresses an issue that was until recently taboo: children fathered by Black American GIs who were stationed in Europe during and after World War II and whose mothers were local citizens. They were born into societies that defined themselves as White and rejected this extremely visible portion of the so-called occupation children. Black and White are in this volume not (only) understood as descriptions of skin color, but above all as social constructs and political categories with racist attributions and effects. The authors of the contributions examine the manner in which these mixed-race children and their mothers were treated by their societies and the respective authorities; they assess the experiences and self-understandings of the individuals affected; they discuss their institutionalization and the strategy practiced by the youth welfare agencies of giving these children up for adoption abroad; and finally they highlight how African American couples in the USA interpreted the adoption of these mixed-race children from Europe as an act of Black resistance against White supremacy.

International social work policy and professional standards driven by the juxtaposition of neo-liberalism and social justice has become a cornerstone of national and local professional practice contexts. Practice relating to safeguarding children has developed globally through the process of political globalisation, "connecting large scale societies together in a whole variety of ways, from international political agreements electronic communication technologies and more fluid migration patterns.” (Giddens, 2009:110) Policy development and implementation by Supra-National organisations such as the United Nations are often created as universal ‘blanket policies’, with the aim of promoting equality and social justice for all. For example child protection policy in both countries has been influenced by the United Nations Convention on the Rights of the Child (UNCRC) (1989). However” local policy and practice will nevertheless be influenced by national contexts and ‘mediated by country specific institutional arrangements’ – a process describe(d) as ‘glocalization’.” (Lyons et al 2006:34) Further to this national policy development is often not constrained to its boarders and can influence policy development internationally. “Increasingly, national policies are ‘rarely purely domestic in impact’ but have international implications, either because they impact directly or because of ‘social policy emulation’.” (Healy, 2001 cited in Lyons et al,2006:28) Global communication and the availability of data and research has become instantaneous. International and professional leaders and academics are able to compare and contrast theoretical perspectives, policies and practices and adapt them to fit local contexts.
