This work contains the papers of the thirteenth Conference on “Antitrust between EU Law and national law”, held in Treviso on May 24 and 25, 2018 under the patronage of the European Lawyers Union – Union des Avocats Européens (UAE), the Associazione Italiana per la Tutela della Concorrenza - the Italian section of the Ligue Internationale du Droit de la Concurrence (LIDC)-, the Associazione Italiana Giuristi di Impresa (AIGI), the European Company Lawyers Association (ECLA), and the Associazione Antitrust Italiana (AAI). Some of the papers have been extensively reviewed and updated by the authors prior to publication. The contributions contained in this volume are the result of an in-depth analysis and study of the most salient issues arising from the application of antitrust rules, carried out by experienced and high-ranking professionals, in-house lawyers, academics and EU/national and international institutional representatives who attended the Conference. They deal with extremely topical issues, lying at the heart of current antitrust debate. Some of the most contemporary topics include those related to private antitrust enforcement after the implementation of Directive 2014/104/EU, and to the interplay between antitrust and intellectual property rights. Ample consideration is also given to recent developments in the field of new technologies and the related antitrust issues, as well as to the relations between consumer protection and antitrust.

This work contains the papers of the Ninth Conference on “Antitrust between EU Law and national law”, held in Treviso on May 20 and 21, 2010 under the patronage of the European Lawyers’ Union – Union des Avocats Européens (UAE), the Associazione Italiana per la Tutela della Concorrenza - the Italian section of the Ligue Internationale du Droit de la Concurrence (LIDC)-, the Associazione Italiana Giuristi di Impresa (AIGI), and the European Company Lawyers Association (ECLA). Some of the papers have been extensively reviewed and updated by the authors prior to publication. Contributions contained in this volume are the result of an in-depth analysis of the most salient issues related to the enforcement of antitrust provisions, carried out by the experienced and high-ranking professionals, company lawyers, academics and officials who attended the Conference. Contributions deal with issues of topical importance such as the impact of the global economic crisis on the enforcement of competition rules and the relationship between antitrust and independent professions. Moreover, more general topics, such as the efficacy of the main public enforcement tools,(including leniency programmes, commitments and the settlement procedure), as well as the latest developments in private enforcement (with specific focus on class actions, recently introduced in the Italian legal system), are addressed from a practical perspective.

In light of criticism in recent years of the European Community's competition law, Amsterdam lawyer Wesseling tries to clarify the current challenges to the policy by examining the origins of the competition law system. He begins by tracing the policy's development from the European Economic Community, established in 1958, and the European Union of today. Then he addresses the pertinent objectives, the institutional framework, the division of jurisdiction between the Community and the Member States, the decentralized enforcement of Community law, and other issues. His conclusions differ considerably from the Commission's recent white paper. Distributed in the US by ISBS. c. Book News Inc.

Some of the papers were substantially reviewed and updated by their Authors just before publication. The contributions collected in this work dealt with the major and current issues involving antitrust matters including analysis of the latest developments in the enforcement of EC antitrust law in the post-modernisation era as well as the increasing importance of private enforcement, in particular in the light of the récent publication by the European Commission of its White Paper on Damages actions for breach of EC antitrust law. Considarable reflection was also given to specific topics such as the interference between antitrust law and consumer protection law, the abuse of dominant position - highlighting the importance of economic analysis in evaluating this category of antitrust breach - and the role of class actions in antitrust cases. This publication also contains contributions concerning compétition issues of specific sectors such as public procurement, aviation, energy, pharmaceuticals and télécommunications.
