Be it further enacted, That all the acts and clauses of acts, here tofore passed in this State, having for their object the suppression of gaming, and which were in force immediately prior to the passage of the act of onethousand eight hundred and twenty two, above recited, be, and the same are hereby declared to be in full force and virtue; and in addition to the penalties therein prescribed, it is hereby provi ded, that each and every person who shall, after the first day of April Additional next, construct, erect, keep up, or use any public gaming table, or Dwell) place, at which games ofchance shall be played, by whatever name called, shall be subject to indictment in any court of record having ju risdiction ofthe offence; and upon conviction shall be fined at the dis cretion of the court, not less than two hundred dollars, and imprison ed not less than one.
