Excerpt from Thompson's Treatise on the Law of Highways: Including Ways, Bridges, Tunnels, Strays, Railroads in Streets, Elevated Roads, Turnpikes, and Plank Roads, Etc;; With an Appendix of Forms No apology is necessary to account for the appearance of another edition of this work. Since the third edition was issued in 1880 there have been nine years of law-making, during which the Legislature has passed seventy laws relating to the general subject of highways, besides a large number of local acts; and in the numerous cases reported in thirty volumes of the Court of Appeals Reports, twenty-seven of Supreme Court Reports and twenty-six of the New York State Reporter, the courts have endeavored to bring order out of the chaos occasioned by hasty legislation. Among other important changes the liability of towns for damages has been established by chapter 700 of the Laws of 1881, and the courts have passed upon this point in many important cases. The subjects of telegraph poles, elevated railroads, railroads in streets, and kindred topics, have been litigated, and while the questions involved have not yet been satisfactorily settled, an advance has been made which has materially altered their status in the courts. All the cases bearing upon these subjects, as well as the ones already embraced in the work, have been studied, and their effect upon the previous laws carefully noted; the entire work has been thoroughly revised, and every authority verified. In the later cases the date has been given, so that the effect of laws passed after their appearance may be guarded against by the practitioner. The work embraces decisions contained in 26 N. Y. State Reporter, 114 New York Reports, 53 Hun, and also the Laws of 1889. I trust that this may receive the flattering reception accorded to the former editions, and may prove useful to the profession as well as to highway officers.
