During the last three decades many countries in the world improved forest tenure by offering greater recognition of indigenous and community rights to manage forests. In many Latin American countries, the community and smallholder forest enterprises are increasing in number, with some developing strong associations and alliances to promote and sustain their growth. Their potential, however, has yet to be fully realized as significant obstacles to their expansion and growth still exist in a number of countries. The publication aims to support forest policy decision makers in understanding the status and dynamics of small scale forest enterprises in Latin America, their needs and challenges in order to help them set up appropriated enabling environment (policy, legal, institutional) that are conducive to scale up the sustainable development of SSFE. This publication contributes to SO3 Reduce rural poverty and particularly to output 1.2 Governments and relevant stakeholders are empowered to promote and implement pro-poor approaches, policies, programmes improving access to and sustainable management of natural resources as well as to output 1.3 Governments and relevant stakeholders are empowered to provide poor rural producers and households with appropriate technologies and access to knowledge, inputs and markets.

Who has rights to forests and forest resources? In recent years governments in the South have transferred at least 200 million hectares of forests to communities living in and around them . This book assesses the experience of what appears to be a new international trend that has substantially increased the share of the world's forests under community administration. Based on research in over 30 communities in selected countries in Asia (India, Nepal, Philippines, Laos, Indonesia), Africa (Burkina Faso, Cameroon, Ghana) and Latin America (Bolivia, Brazil, Guatemala, Nicaragua), it examines the process and outcomes of granting new rights, assessing a variety of governance issues in implementation, access to forest products and markets and outcomes for people and forests . Forest tenure reforms have been highly varied, ranging from the titling of indigenous territories to the granting of small land areas for forest regeneration or the right to a share in timber revenues. While in many cases these rights have been significant, new statutory rights do not automatically result in rights in practice, and a variety of institutional weaknesses and policy distortions have limited the impacts of change. Through the comparison of selected cases, the chapters explore the nature of forest reform, the extent and meaning of rights transferred or recognized, and the role of authority and citizens' networks in forest governance. They also assess opportunities and obstacles associated with government regulations and markets for forest products and the effects across the cases on livelihoods, forest condition and equity. Management decisions on appropriate practices and policies regarding tropical forests often need to be made in spite of innumerable uncertainties and complexities. Among the uncertainties are the lack of formalization of lessons learned regarding the impacts of previous programs and projects. Beyond the challenges of generating the proper information on these impacts, there are other difficulties that relate with how to socialize the information and knowledge gained so that change is transformational and enduring. The main complexities lie in understanding the interactions of social-ecological systems at different scales and how they varied through time in response to policy and other processes. This volume is part of a broad research effort to develop an independent evaluation of certification impacts with stakeholder input, which focuses on FSC certification of natural tropical forests. More specifically, the evaluation program aims at building the evidence base of the empirical biophysical, social, economic, and policy effects that FSC certification of natural forest has had in Brazil as well as in other tropical countries. The contents of this volume highlight the opportunities and constraints that those responsible for managing natural forests for timber production have experienced in their efforts to improve their practices in Brazil. As such, the goal of the studies in this volume is to serve as the foundation to design an impact evaluation framework of the impacts of FSC certification of natural forests in a participatory manner with interested parties, from institutions and organizations, to communities and individuals.

Natural resource governance is critical for linking poverty reduction and sustainable natural resource use. This book brings together authors from various disciplines with extensive field experience to promote an integrative understanding of cross-scale and adaptive governance in Africa and Latin America. The authors make the case for reaching beyond decentralization to promote adaptive governance that serves local priorities, but through interactions with local, district, national and global governance structures. The book focuses on the governance of common pool resources such as forests, wildlife, water, carbon and pasture resources in both Africa and Latin America. This book will appeal to development practitioners and scholars concerned about the conservation of natural resources and the sustainable development of communities. It synthesizes experience with the governance of different natural resources from a broad geographic perspective. It also provides theoretical and practical suggestions for taking adaptive natural resource governance forward, including participatory methods for measuring and monitoring governance.

In this work, the attempt is made to explore and understand the interaction between different institutions in environmental governance, and the role of human livelihood strategies in this interaction. With a case study of teak farming and sand winning in the Dormaa Municipality and Dormaa East district in midwestern Ghana, the work seeks to contribute to understanding the dynamics and role of institutions and human behaviour relationship in environmental governance. The study has been formulated and conducted following some observations of interaction between statutory and customary institutions in regulating human activities on the natural environment in Dormaa. Prior to this study, observations of this author in some communities in the Dormaa Municipality and Dormaa East district showed that statutory and customary environmental governance institutions influenced each other to shape the ways different people acted on the natural environment. Moreover, it was observed that the actions of people in turn influenced how these institutions functioned and affected each other.

The Routledge Handbook of Private Law and Sustainability reflects on how the law can help tackle the current environmental challenges and make our societies more resilient to future crises. Sustainability has been high on the political agenda since the approval of the Sustainable Development Goals in 2015 and the EU Green Deal in 2019. The Green Agenda aims at making Europe the first climate‐neutral continent by 2050, but humanity persists in an ecological overshoot that puts at risk the survival of species, including that of our own. Drawing together a selection of leading thinkers in the field, this Handbook provides a curated overview of the most recent and relevant discussions for private lawyers related to environmental and sustainability concerns. The authors delve into case study examples from 20 countries in Europe and beyond and discuss a wide range of issues, including new property law and consumer law paradigms, the use of legal tech for promoting sustainable property management, strategies for fighting planned obsolescence, eco‐design, the servitisation economy, advances on corporate climate litigation and mandated green private sludges. Overall, the volume is designed to empower new generations of legal scholars to take an active role in the transition to a more sustainable future. It will also assist policymakers in producing better policy, through pinpointing the main legal issues that need to be addressed and offering a comparative overview of legal solutions and best practices. Divided into six key parts and overseen by a team of internationally recognised expert editors, this Handbook will be an essential resource for students, scholars, private lawyers and policymakers who wish to have a comprehensive, fundamental overview of how environmental sustainability concerns reflect on private law.
