As you are aware, Mr. Chairman, the current Enabling Acts re quire the Supreme Court to transmit proposed rules to Congress during a regular session, but not later than May 1. Under the present acts, the rules automatically become effective unless Con gress takes some action within 90 days - except for evidence rules, when the period of time is 180 days. "Today's hearings will focus on the process by which the Federal judiciary and Congress go about promulgating Federal Rules of Practice and Procedure. As our witnesses will describe in greater detail later in the hearing, the method by which rules are promulgated is generically called the Rules Enabling Act. These various statutes taken together constitute in part the delegation of congressional authority to the judiciary. Congress has provided that certain types of rules may be made effective in the Federal courts if they are issued by the Supreme Court and, in essence, not vetoed by the Congress.
