This book explores the normative foundations of ASEAN and the EU. It revives the history of the two organizations in an in-depth narrative of the protracted arguments surrounding their establishment, legal integration and enlargement. While political actors used norms to legitimize their ideas for institutional change, the complex and dynamic nature of these norms also provided the breeding ground for contestation and, sometimes, institutional sclerosis and failure. Recasting these processes in an innovative English School framework, the volume makes a crucial contribution to the literature of Comparative Regionalism that goes beyond Eurocentric perspectives.

On these premises, in Non-Governmental Interests in Regional Organizations: The Role of Parliamentary, Socio-Economic and Territorial Institutions Elisa Tino aims at analysing the unexplored phenomenon of institutional multipolarism of regional organizations, namely the trend to establish institutions representing non-governmental interests. Particularly, illustrating their diffusion in various geographic areas, explaining rationales underlying their establishment and investigating their institutional aspects, Elisa Tino pinpoints the contribution of these institutions to the development of regional organizations both according to the functionalist approach and the constitutionalist one. Thus, she aims at providing food for thought in the study of international organizations.

Cooperation through international organizations is fundamental to the international legal order. International organizations are nowadays ubiquitous and come in many different manifestations, each allowing for different levels of international cooperation. The profile of regional and universal organizations may vary greatly from one organization to another. At the same time, they do not live apart and this has led to the creation of a complex network of relationships. These relationships have seldom been the object of scholarship, and this book seeks to address that gap. In general, the relationships between international organizations can give rise to such issues as the conditions placed upon one organization by another, demarcations of competence, membership of other organizations, and various forms of collaboration involving the conclusion of agreements between organizations. Optimal coexistence, cooperation and coherence all play a role in optimizing the relations between international organizations. The volume concludes by analysing current challenges, including those of legal identity, responsibility and accountability, as well as making proposals for reform, such as through the development of a common law between organizations.

This book takes up one of the key theoretical challenges in the English School’s conceptual framework, namely the nature of the institutions of international society. It theorizes their nature through an analysis of the relationship of primary and secondary levels of institutional formation, so far largely ignored in English School theorizing, and provides case studies to illuminate the theory. Hitherto, the School has largely failed to study secondary institutions such as international organizations and regimes as autonomous objects of analysis, seeing them as mere materializations of primary institutions. Building on legal and constructivist arguments about the constitutive character of institutions, it demonstrates how primary institutions frame secondary organizations and regimes, but also how secondary institutions construct agencies with capacities that impinge upon and can change primary institutions. Based on legal and constructivist ideas, it develops a theoretical model that sees primary and secondary institutions as shared understandings enmeshed in observable historical processes of constitution, reproduction and regulation.
