En este libro, en 15 capítulos, en español, inglés y francés, se abordan temas como la inmigración irregular en el ámbito mediterráneo, la participación de las Organizaciones Internacionales en la gestión de la inmigración irregular, los Derechos Humanos de los inmigrantes en situación irregular, los inmigrantes en situación irregular en el Derecho Español e inmigración irregular y derecho de asilo.En la realidad soplan malos vientos para los inmigrantes, en general, y especialmente para aquellos que se hallan en situación irregular, sea originaria o sobrevenida. Así lo prueban la Directiva de retorno (con toda justicia calificada como «Directiva de la vergüenza») y la Directiva de sanción a los empleadores de personas en situación irregular{ y también puede decirse que existe un empeoramiento de ciertas legislaciones estatales, como la italiana, la francesa, etc. Frecuentemente se utiliza un peligroso mito para referirse a estas personas: son calificadas como «ilegales», a pesar de que ninguna persona lo es. El mito esconde importantes dosis de xenofobia y de criminalización de personas que simplemente han atravesado irregularmente una frontera o se hallan con una documentación caducada.El respeto de los Derechos Humanos de las personas en situación irregular no siempre se produce en nuestros democráticos Estados de Derecho{ en ellos surge con demasiada frecuencia el cinismo del doble o triple lenguaje. El respeto efectivo de los Derechos Humanos (universales, indivisibles, interdependientes, inalienables e irrenunciables) interesa a todos y a todas. Cuando algún grupo de personas sufre su violación, otras personas (en esta hipótesis, muchos ciudadanos de la Unión) no se dan cuenta de que se cuestiona, sufre y peligra la misma esencia de la democracia.

The crossing of national state borders is one of the most-discussed issues of contemporary times and it poses many challenges for individual and collective identities. This concerns both short-distance mobility as well as long-distance migration. Choosing to move - or not - across international borders is a complex decision, involving both cognitive and emotional processes. This book tests the approach that three crucial thresholds need to be crossed before mobility occurs; the individual’s mindset about migrating, the choice of destination and perception of crossing borders to that location and the specific routes and spatial trajectories available to get there. Thus both borders and trajectories can act as thresholds to spatial moves. The threshold approach, with its focus on processes affecting whether, when and where to move, aims to understand the decision-making process in all its dimensions, in the hope that this will lead to a better understanding of the ways migrants conceive, perceive and undertake their transnational journeys. This book examines the three constitutive parts discerned in the cross-border mobility decision-making process: people, borders and trajectories and their interrelationships. Illustrated by a global range of case studies, it demonstrates that the relation between the three is not fixed but flexible and that decision-making contains aspects of belonging, instability, security and volatility affecting their mobility or immobility.

This book examines the rules governing the right to asylum in the European Union. Drawing on the 1951 United Nations Convention relating to the Status of Refugees, and the 1967 Protocol, Francesco Cherubini asks how asylum obligations under international refugee law have been incorporated into the European Union. The book draws from international law, EU law and the case law of the European Court of Human Rights, and focuses on the prohibition of refoulement; the main obligation the EU law must confront. Cherubini explores the dual nature of this principle, examining both the obligation to provide a fair procedure that determines the conditions of risk in the country of origin or destination, and the obligation to respond to a possible expulsion. Through this study the book sheds light on EU competence in asylum when regarding the different positions of Member States. The book will be of great use and interest to researchers and students of asylum and immigration law, EU law, and public international law.

In Migrant Organising: Community Unionism, Solidarity and Bricolage, Emma Martín-Díaz and Beltrán Roca explore recent developments in community unionism and solidarity networks among migrant workers in a post-Fordist context characterised by transnationalism and global chains. The contributions in this edited book describe different types of trade union strategies toward migrant workers and the rise of solidarity and bricolage initiatives in situations in which conventional union organising cannot succeed. This edited volume analyzes recent key developments in EU border management. In light of the refugee crises in the Mediterranean and the responses on the part of EU member states, this volume presents an in-depth reflection on European border practices and their political, social and economic consequences. Approaching borders as concepts in flux, the authors identify three main trends: the rise of security technologies such as the EUROSUR system, the continued externalization of EU security governance such as border mission training in third states, and the unfolding dynamics of accountability. The contributions show that internal security cooperation in Europe is far from consolidated, since both political oversight mechanisms and the definition of borders remain in flux.
