En La tutela judicial frente al daño ambiental colectivo el autor se propone someter a prueba la aptitud de los ordenamientos jurídicos de Argentina y España para abordar una pretensión de tutela ambiental colectiva. Realiza entonces un análisis comparativo partiendo de la siguiente premisa: la inadecuación de las normas procesales afecta no sólo al acceso a la jurisdicción sino también a la justicia ambiental misma, considerada desde una visión multidimensional (Schlosberg, 2009). Con este cometido, el texto repasa la normativa supranacional dedicada al derecho de acceso a la justicia ambiental —incluyendo el recientemente adoptado Acuerdo de Escazú— y revisa los sistemas de tutela desde la normativa, la doctrina y la jurisprudencia. El autor concluye su obra con consideraciones críticas y propuestas de modificación legislativa, las que entiende necesarias para una adecuada tutela del ambiente, y de los intereses difusos en general, en un contexto de conflictividad global creciente.

The understanding that some pesticides are more hazardous than others is well established. Recognition of this is reflected by the World Health Organization (WHO) Recommended Classification of Pesticides by Hazard, which was first published in 1975. The document classifies pesticides in one of five hazard classes according to their acute toxicity. In 2002, the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) was introduced, which in addition to acute toxicity also provides classification of chemicals according to their chronic health hazards and environmental hazards.
