The member states of the EU have only very recently begun to consider race and racism in the framework of equality legislation and policies. As opposed to an established Anglo-Saxon tradition of naming races and using racial categorisation to fight racism, most continental European countries resist this approach. This book investigates the problematic reception and elaboration of race as a socio-legal category in Europe. Fighting Discrimination in Europe takes a fresh and interdisciplinary look at the normative, theoretical and concrete problems raised by the challenge of devising and enforcing policies to combat race discrimination in Europe. Vast amounts of data are nowadays collected, stored and processed, in an effort to assist in making a variety of administrative and governmental decisions. These innovative steps considerably improve the speed, effectiveness and quality of decisions. Analyses are increasingly performed by data mining and profiling technologies that statistically and automatically determine patterns and trends. However, when such practices lead to unwanted or unjustified selections, they may result in unacceptable forms of discrimination. Processing vast amounts of data may lead to situations in which data controllers know many of the characteristics, behaviors and whereabouts of people. In some cases, analysts might know more about individuals than these individuals know about themselves. Judging people by their digital identities sheds a different light on our views of privacy and data protection. This book discusses discrimination and privacy issues related to data mining and profiling practices. It provides technological and regulatory solutions, to problems which arise in these innovative contexts. The book explains that common measures for mitigating privacy and discrimination, such as access controls and anonymity, fail to properly resolve privacy and discrimination concerns. Therefore, new solutions, focusing on technology design, transparency and accountability are called for and set forth.

This book provides the main findings of a ground-breaking survey on immigrants and the second generation in France. The data, collected from more than 20, 000 persons representative of the population living in France, offer invaluable insights into the trajectories and experience of ethnic minorities. The book explains how France has been an immigrant-receiving country for over a century and how it is now a multicultural society with an unprecedented level of origin diversity. While immigrants and their descendants are targets of clichés and stereotyping, this book provides unique quantitative findings on their situation in all areas of personal and working life. Is origin in itself a factor of inequality? With its detailed reconstitutions of educational, occupational and conjugal trajectories and its exploration of access to housing and health, this book provides multiple approaches to answering this question. One of the work’s major contributions is to combine objective and subjective measures of discrimination: this is the first study in France to focus on racism as experienced by those subjected to it, while opening up new methodological perspectives on the experience of prejudice by origin, religion, and skin colour.
