This book examines patterns of environmental regulation in the European Union and four federal polities--the United States, Germany, Australia, and Canada. Daniel Kelemen develops a theory of regulatory federalism based on his comparative study, arguing that the greater the fragmentation of power at the federal level, the less discretion is allotted to component states. Kelemen's analysis offers a novel perspective on the EU and demonstrates that the EU already acts as a federal polity in the regulatory arena. In The Rules of Federalism, Kelemen shows that both the structure of the EU's institutions and the control these institutions exert over member states closely resemble the American federal system, with its separation of powers, large number of veto points, and highly detailed, judicially enforceable legislation. In recent years a series of scandals have challenged the traditional political reliance on public constitutional law and human rights as a safeguard of human well-being. Multinational corporations have violated human rights; private intermediaries in the internet have threatened freedom of opinion, and the global capital markets unleashed catastrophic risks. All of these phenomena call for a response from traditional constitutionalism. Yet it is outside the limits of the nation-state in transnational politics and outside institutionalized politics, in the 'private' sectors of global society that these constitutional problems arise. It is widely accepted that there is a crisis in traditional constitutionalism caused by transnationalization and privatization. How the crisis can be overcome is one of the major controversies of modern political and constitutional theory. This book sets out an answer to that problem. It argues that the obstinate state-and-politics-centricity of traditional constitutionalism needs to be counteracted by a sociological approach which, so far, has remained neglected in the constitutional debate. Constitutional sociology projects the questions of constitutionalism not only onto the relationship between public politics and law, but onto the whole society. It argues that constitutionalism has the potential to counteract the expansionist tendencies of social systems outside the state world, particularly of the globalized economy, science and technology, and the information media, when they endanger individual or institutional autonomy. The book identifies transnational regimes, particularly in the private area, as the new constitutional subjects in a global society, rivals to the order and power of nation states. It presents a model of transnational, societal constitutional fragments that could bring the values of constitutionalism to bear on these private networks, examining the potential horizontal application of human rights in the private sphere, and how such fragments could interact. This book examines Max Weber's understanding of bureaucracy by applying his ideas to the development of officialdom from the ninth century to the present in six territories: England, Sweden, France, Germany, Spain, and Hungary. Edward Page takes a broad view of bureaucracy that includes not only officials in important central or national institutions but also those providing goods and services locally. The 'scorecard' is based on expected developments in four key areas of Weber's analysis: the functional differentiation of tasks within government, professionalism, formalism, and monocracy. After discussing the character of officialdom in the ninth, twelfth, fifteenth, eighteenth, and twenty-first centuries, the book reveals that Weber's scorecard has a mixed record, especially weak in its account of the development of monocracy and formalism. A final chapter discusses alternative conceptions of bureaucratic development and sets out an account based on understanding processes of routinization, institutional integration, and the instrumentalization of law.

"This book reconstructs the tantalizing tale of Sri Sabhapati Swami (ca. 1828-1923/4), today a little-known swami who was originally from Tamil Nadu in southern India, and historically contextualizes a fascinating type of yoga that Sabhapati claimed would lead to an experience of being "like a tree universally spread." The practical method of having this experience, in technical terms called the samadhi or "composure" of sivarajayoga or the "Royal yoga for siva," was published in English and multiple Indic languages and lavishly illustrated in diagrams on subtle and physical bodies. This book is the first book-length treatment on Sabhapati Swami, scholarly or otherwise, and uses critically-edited sources printed in Tamil, Devanagari, and Bengali scripts to reveal the expansion of his literature across South Asia and globally, the vast majority of which has never before been considered in any scholarly work to date. The book shows how intertwined Sabhapati's yoga is with historical Tamil saiva and Siddha movements, including the mythos of the rishi Agastya, and also with Hathayoga and mantra-based ritual. It also takes into account his and his followers' wrestling with the Victorian scientific worldview and their rationalization of Hindu philosophical discourses in the colonial period. Finally, the book demonstrates the extent to which Sabhapati's teachings were integrated into esoteric religious movements such as the Theosophical Society, the Thelema of Aleister Crowley, and New Thought, and suggests that a reappraisal of scholarship on the roots of yoga in these movements is long overdue"--
