Without offering full membership, the EU nevertheless attempts to transfer its rules and policies to non-member countries. This book examines migration as a key element of the European Union's (EU’s) foreign policy and thus a critical domain for understanding and evaluating EU external action. It documents, explains, and assesses the implementation of EU migration policies, especially after the crisis of 2015, providing a much-needed overall evaluation and comparison in different geographic contexts. Applying a composite approach to global political justice, it affords a normative assessment of EU’s action and shows the tensions between the justice claims of the many actors involved in the EU migration system of governance. This book takes a fresh look at the external relations of the European Union (EU) and in particular the Common Foreign and Security Policy (CFSP). Rather than focusing exclusively on the competence aspects of the institutions and actors, the book makes the case that the CFSP can be understood as a system of governance, which produces effects beyond the traditional tools associated with foreign policy. The theoretical approach draws on insights from new institutionalism, constructivism and the institutional theory of law and emphasises how the institutionalised forms of cooperation in the external sphere contribute to a social reality in which the ‘added value’ of the CFSP can be seen. Paul James Cardwell takes the Euro-Mediterranean Partnership (EuroMed) as a case study. Not initially a CFSP project, EuroMed has become the frame for EU foreign policy in the region as an emerging system of governance in which the EU institutions play a central role. Having recently been relaunched as the Barcelona Process: Union for the Mediterranean, it is a topical subject. With the increasing importance of migration on the EU’s agenda, the book looks at the relationship between migration, EuroMed and the CFSP and argues that the legal effects of the CFSP can be felt beyond the Treaty-based instruments. This book examines the varied competences of the European Union (EU) in relation to its capacity to externalize its policy preferences. Specifically, it explores the continued resilience within the EU's policy toolbox of supranational modes of governance beyond the State. The book first situates European experiences of supranationality in relations to the wide variety of regional and global modes of governance it comes into contact with when seeking to deal with an increasingly complex and fragmented international environment. Over the course of its subsequent sections, the book analyses the resilience, flexibility and adaptability of the EU's supranational practices across a significant cross-section of policy fields, for example, Area Freedom of Justice, Justice and Security; Socio-economic Governance; or Trade Policies. Overall, these chapters unpack the impact of the EU's internal institutional complexity on the EU's external capacity to export its preferences in an increasingly fragmented international environment. This in turn, sees the book also question whether the EU has the institutional tools to guarantee and implement consistency between its internal and external policies. The European Neighbourhood Policy (ENP) was initially intended to create ‘a ring of friends surrounding the Union, from Morocco to Russia and the Black Sea’ (Prodi, 2002). Today, however, the ever-worsening security situation in the region clearly shows that the aim has not been achieved. With wars in Ukraine, Syria and Libya, the Union’s neighbourhood can therefore better be described as ‘a ring of fire’. Does this means that the policy has failed and that an alternative policy towards the EU’s neighbours is needed? Or should these developments be seen as temporary setbacks caused by external factors beyond EU control? By comparing the EU’s approach to its eastern and southern neighbours, this volume seeks to answer such overarching questions. The authors find that the EU still has a potential role to play in providing regional security, but that this role also risks being increasingly undermined if it does not increasingly take into account the broader geostrategic realities in both regions.

This book offers a conceptualisation of unintended consequences and addresses a set of common research questions, highlighting the nature (what), the causes (why), and the modes of management (how) of unintended consequences of the European Union’s (EU) external action. The chapters in the book engage with conceptual and empirical dimensions of the topic, as well as scholarly and policy implications thereof. They do so by looking at EU external action across various policy domains (including trade, migration, development, state-building, democracy promotion, and rule of law reform) and geographic areas (including the USA, Russia, the Western Balkans, the southern and eastern European neighbourhood, and Africa). The book contributes to the study of the EU as an international actor by broadening the notion of its impact abroad to include the unintended consequences of its (in)actions and by shedding new light on the conceptual paradigms that explain EU external action. This book fills the gap in IR and EU scholarship concerning unintended consequences in an international context and will be of interest to anyone studying this important phenomenon.
