Cette recherche porte sur des dynamiques plurielles d’accès au droit et à la justice chez les plus pauvres. Dans le contexte actuel marqué par la mondialisation du capitalisme, on assiste à la judiciarisation galopante de la société qui semble induite par la première; les individus aspirent de plus en plus à être des sujets de droit et tout ou presque se réfère à la justice. Dans le même temps, l’enrichissement démesuré des uns et l’appauvrissement des autres n’a pas réduit le fossé et les tensions entre riches et pauvres, forts et faibles. Si la justice est un besoin fondamental inné chez tout être humain, accéder à ses institutions et en obtenir des décisions à sa faveur à juste titre reste dans une certaine mesure dans l’imaginaire et dans la réalité de moult sociétés, comme étant l’apanage des plus nantis et des plus forts. Aussi, des dynamiques personnelles, sociales, culturelles, citoyennes, internationales, se forment et se développent pour briser ce déterminisme en prêtant main forte aux indigents afin qu’ils puissent accéder à la justice. En effet, face à la cherté et la complexité de la justice institutionnelle, de multiples acteurs se mobilisent autour des citoyens démunis et à travers des mécanismes alternatifs internes à la justice institutionnelle, ou parallèles à celle-ci.Ces formes de justice, émergentes ou résurgentes, aussi bien dans l’espace privé que dans l’espace publique, qui s’adaptent à la rationalité du droit moderne ou qui participent d’autres rationalités et cultures, interrogent d’une part l’Etat de droit, la gouvernance et le développement, et d’autre part l’universalisme et le particularisme. Il s’agit de trouver à travers chacune des justices, la preuve qu’elle contribue à la défense des droits humains universels, corollaire de la subjectivation.

En ce début de XXIe siècle, la pauvreté et les inégalités affectent un nombre croissant de personnes sur le continent européen. Ces phénomènes fragilisent non seulement la cohésion sociale des sociétés européennes mais voient les droits humains, aussi bien les droits sociaux que civils et politiques, et questionnent le fonctionnement de la démocratie. En effet, comment les personnes en situation de pauvreté peuvent-elles faire entendre leurs voix dans des sociétés polarisées, où plus de 40% du patrimoine et 25% des revenus sont détenus par 10% de la population ? Ce guide est le fruit de deux années de travail collectif mené dans le cadre du projet « Les droits humains des personnes en situation de pauvreté ». Il a été préparé avec le concours de nombreuses personnes et organisations, dont des personnes en situation de pauvreté, des chercheurs, des associations et des représentants des autorités politiques. Outre qu’il offre une étude critique de la situation actuelle, en analysant les inégalités et la pauvreté par le prisme des droits humains, de la démocratie et des politiques de redistribution, ce guide invite également le lecteur à explorer les pistes d’une stratégie renouvelée de lutte contre la pauvreté permettant de rétablir les sens de la justice sociale. Il avance des propositions qui visent à dépasser la stigmatisation et la catégorisation, en ouvrant des voies d’apprentissage pour bâtir des biens communs par le partage, en évitant le gaspillage et en renforçant dans la conscience publique le principe de respect de la dignité humaine en tant que droit de tous.

Le terme promotion de la santé en Afrique, près de 30 ans après l'adoption de la Charte d'Ottawa, continue d'avoir des connotations complètement hors du sens que lui confère cette charte. Cela n'est pas étonnant quand on sait que la notion de santé dans ce contexte africain équivaut à la lutte contre la maladie à travers les soins de santé dispensés par des professionnels de la santé dans des formations sanitaires et les hôpitaux. L'évolution que connait le continent depuis quelques décennies est de donner un peu plus de place à la communauté à travers les relais communautaires dans une participation communautaire vidée de son contenu, car le pouvoir n'est jamais passé entre les mains des communautés.C'est au vu de tout ceci que le présent ouvrage à sa raison d'être pour expliquer les fondements de l'autonomisation communautaire et de la promotion de la santé avec leur importance pour la région africaine en proie aux mauvais indicateurs de santé comparativement aux autres régions du monde.

Too often we think of the modern political state as a universal institution, the inevitable product of History rather than a specific creation of a very particular history. Bertrand Badie and Pierre Birnbaum here persuasively argue that the origin of the state is a social fact, arising out of the peculiar sociohistorical context of Western Europe. Drawing on historical materials and bringing sociological insights to bear on a field long abandoned to jurists and political scientists, the authors lay the foundations for a strikingly original theory of the birth and subsequent diffusion of the state. The book opens with a review of the principal evolutionary theories concerning the origin of the institution proposed by such thinkers as Marx, Durkheim, and Weber. Rejecting these views, the authors set forward and defend their thesis that the state was an "invention" rather than a necessary consequence of any other process. Once invented, the state was disseminated outside its Western European birthplace either through imposition or imitation. The study concludes with concrete analyses of the differences in actual state institutions in France, Prussia, Great Britain, the United States, and Switzerland.

How social and intellectual changes undermine our justifications for the welfare state The welfare state has come under severe pressure internationally, partly for the well-known reasons of slowing economic growth and declining confidence in the public sector. According to the influential social theorist Pierre Rosanvallon, however, there is also a deeper and less familiar reason for the crisis of the welfare state. He shows here that a fundamental practical and philosophical justification for traditional welfare policies—that all citizens share equal risks—has been undermined by social and intellectual change. If we wish to achieve the goals of social solidarity and civic equality for which the welfare state was founded, Rosanvallon argues, we must radically rethink social programs. Rosanvallon begins by tracing the history of the welfare state and its founding premise that risks, especially the risks of illness and unemployment, are equally distributed and unpredictable. He shows that this idea has become untenable because of economic diversification and advances in statistical and risk analysis. It is truer than ever before—and far more susceptible to analysis—that some individuals will face much greater risks than others because of their jobs and lifestyle choices. Rosanvallon argues that social policies must be more narrowly targeted. And he draws on evidence from around the world, in particular France and the United States, to show that such programs as unemployment insurance and workfare could better reflect individual needs by, for example, making more explicit use of contracts between the providers and receivers of benefits. His arguments have broad implications for welfare programs everywhere and for our understanding of citizenship in modern democracies and economies.
