It was initially argued that the funds, with which some slaves were purchased by his intestate, belonged to Alexander Carter, and were held by the intestate, Davis, as Carter's agent. Therefore it was suggested that all the slaves ought to be delivered back to Carter's executor. This took place as per the decree made by the Court of Equity in Craven County. Then, a new bill was introduced to argue that in fact only half of the funds actually belonged to Carter and that the other half belonged to the intestate Davis. The new bill asked for a division of the slaves to reflect this and further stated that the original slaves were a woman and 2 children, and that they have increased to the number of 10 or more, and that their maintenance was troublesome and expensive, and ought to be reasonably compensated. This new bill was dismissed on grounds that the facts should have been properly presented in the first instance.
