A new moral, ethical, and legal framework is needed for international human rights law. Never in human history has there been such an elaborate international system for human rights, yet from massive disasters, such as the Darfur genocide, to everyday tragedies, such as female genital mutilation, human rights abuses continue at an alarming rate. As the world population increases and global trade brings new wealth as well as new problems, international law can and should respond better to those who live in fear of violence, neglect, or harm. Modern critiques global human rights fall into three categories: sovereignty, culture, and civil society. These are not new problems, but have long been debated as part of the legal philosophical tradition. Taking lessons from tradition and recasting them in contemporary light, Helen Stacy proposes new approaches to fill the gaps in current approaches: relational sovereignty, reciprocal adjudication, and regional human rights. She forcefully argues that law and courts must play a vital role in forging a better human rights vision in the future.

"Sovereignty in the 21st Century describes a world already at war with itself. It is a world in which urban globalists fear and despise regional nationalists, and vice-versa. It is a time when the concept of the nation-state sovereignty incarnate has slipped from the minds of many. The populations of the mega-cities have as they have in different ways in the past assumed that they alone represented the state . The response to this has been a voter revolt in many areas of the world and the sudden re-appearance of the schisms between cities and regions. Nationalism has become, for many in the cities, a pejorative term, but an expression of hope for revival of many in the regions. But what do we know of the issues which are really at stake in this changing century? Can we adequately describe the meaning of sovereignty of individuals as well as states or the fundamental differences between republics and constitutional monarchies; between empires and suzerainties? Yet all these issues will determine whether we will live in calm and prosperity, or chaos and fear. This may be the most remarkable book yet by Gregory Copley"--Amazon.com

In the freshest new international law text in 20 years, Christopher C. Joyner offers a critical assessment of international legal rules in the early 21st century as they are applied by governments to the real world. Looking at concepts and principles, processes and critical problems, Joyner steers clear of an old-time case method approach, preferring to treat issues thematically. He shows the challenges of international law in terms of peace, security, human rights, the environment, and economic justice. Particular features of the book include engaging vignettes, clearly defined key terms, and special coverage of emerging topics including common spaces; international criminal law; rules, norms, and regimes; and trade relations and commercial exchange. Through it all, Joyner maintains an intent focus on the role of the individual in the evolving international legal order.

When God is “dead” and governments themselves are increasingly subject to the power of global corporations, massive movements of peoples, transnational political upheavals, and ecological disasters, what does sovereignty mean for the 21st century? Sovereignty in the 21st Century is Carl Raschke's deep theoretical dive into the meaning of sovereignty in both its historical and contemporary settings, showing how the idea can be expanded beyond politics and offer emancipatory strategies for previously marginalized peoples. Picking up Carl Schmitt's idea of sovereignty's 'divine' associations making it an implicitly theological concern, Raschke explains how political and religious thought have always been intertwined. These intertwined strands find their relevance today in debates around class, race and domination, making the question of sovereignty not just a political but a social and economic one. Bringing to light the ways in which great transnational conflicts today are not between authoritarianism and democracy but between neoliberalism and populism, this book brings us closer to a profound understanding of what we truly mean by democracy, or 'popular' sovereignty in the 21st-century.
