HE plaintiffs in this case were the executors of G. Bar-A Railway ker, who died possessed of a lease for a term of years, which notice&afthey required ten parcels of land, on one of which was a brine-pit and steam-engine connected with certain saltworks. The parties could not agree upon the price. The Company then caused a valuation to be made of eight out of the ten parcels; they deposited the determined snm, and gave a bond under their corporate seal, but without sureties, and entered upon the eight parcels, under the 85th section of the Lands Clauses Act. Excerpt: ...by the above-named Company against a not the correct poor-rate made on the 20th November, 1847, for the parmode of rating a railway to the relief of the poor; but the value which the land occupied in each parish produces, after the due allowances, is that upon which the railway is to be rated in such parish. Any expenses, wherever arising, which the Company can shew to be necessary for keeping the hereditaments, which are the subject of the assessment, attheirvalue.andforthejustprotection of the Company in each parish, may properly be taken into consideration. C. was within that parish: --Hdd, that this was the same in substance as if so many tickets were daily issued, without money paid for..
